The Gillard Government's Malaysian solution has been
thrown into disarray by a High Court ruling
that found the policy was invalid.

UPDATE 5.45pm: THE Government admits a High Court ruling ending the
Malaysian asylum deal is "a blow", as the Opposition says it was the
latest in a series of bungles.
No asylum seekers will be sent to Malaysia for the foreseeable
future after the High Court put a stop to the Federal Government's
people swap deal.
The Opposition now says the Coalition's former policy of dealing with asylum seekers in Nauru is the Government's only option.
Immigration Minister Chris Bowen said he was proud of the policy despite significant "blow" of the legal loss.
"Let's make no bones about it - today's decision by the High Court is a
profoundly disappointing one. Disappointing for the government,
disappointing for me,'' Mr Bowen said.
"I respect the High Court's decision, but it doesn't mean I walk away from the fundamental points of the policy, which is one the Government can continue to be proud of.''

processing of asylum seekers and it had commissioned fresh new legal
advice.

"It means we currently have 2000 people less in immigration detention
facilities than we had just three months ago. We've had the people

determination to break the people smugglers' business model.''
He conceded the number of asylum seekers heading here would rise following the High Court decision.
"I think you can expect people smugglers to be capitalising on this arrangement,'' he said.
Mr Bowen insisted the Government had been on solid legal footing on its
original advice, but said the High Court had applied a new test to "how
protections should be demonstrated''.
"Clearly that is something which had not been understood before,'' he said.
He could not comment on the fate of 330 detainees who had been on standby
to be flown to Malaysia if the court had upheld the policy.
Mr Bowen said the Government had told Malaysia of the decision, but said it
would not be pushing Malaysia to change any of its laws.
Coalition says its time for the Nauru solution again
The Opposition has long called on Labor to reopen the mothballed
processing centre on Nauru which was a key plank in the former Howard
government's so-called Pacific Solution, with even former Labor
powerbroker Graham Richardson saying they would need to consider the option.
"Policy failure is never anything you would welcome but what we have seen today
in the High Court is yet another recognition of yet another policy failure by
this incompetent government,'' Opposition Immigration spokesman Scott Morrison said.
"This is a government whose failed non-solution for East Timor has now been followed up by
their Malaysia non-solution, prior to that was their failed asylum freeze.''
He said Mr Bowen's Malaysia deal failure was a bungle that went "together with everything from pink bats, and school hall rip offs and the NBN and border protection failures, a government that simply can't get anything right''.
Former Labor powerbroker Graham Richardson said the Government
has taken a thumping in the High Court and now had no alternative but to swallow its pride and opt for a Nauru solution for asylum seekers.
Mr Richardson said the decision
made the Government look like a joke
"because frankly at the moment it is''.
He said everyone would have told the Government there would be a legal
challenge and whoever provided the legal advice that it was safe should be sacked.
"This is a thumping in the High Court,'' Mr Richardson told Sky News.
"They didn't just go down. They got slaughtered.
"There's nothing else for the government to do but to look elsewhere, and where else can you look bar Nauru?''
Mr Richardson said if the Government did opt for Nauru it should
"announce it quickly in the next couple of days''.
High Court's decision leaves asylum deal in tatters
Chief Justice Robert French said the court ordered Mr Bowen and his
department be restrained from sending asylum seekers to Malaysia.
"The declaration made was made without power and is invalid," Justice French said.
In a written summary of its judgment today, the High Court said it found the asylum deal could not proceed.
"Today the High Court held invalid the Minister for Immigration and
Citizenship's declaration of Malaysia as a country to which asylum
seekers who entered Australia at Christmas Island can be taken for
processing of their asylum claims," it said.
"After an expedited hearing before the Full Bench, the Court by majority made permanent the injunctions that had been granted earlier and restrained the Minister from taking to Malaysia two asylum seekers who arrived at Christmas Island, as part of a larger group, less than four weeks ago.
"The Court also decided that an unaccompanied asylum seeker who is under 18
years of age may not lawfully be taken from Australia without the Minister's
written consent under the Immigration (Guardianship of Children) Act 1946 (Cth)."
The High Court heard the case after Victorian human rights lawyer David Manne sought
an injunction on behalf of asylum seekers who were to be deported to Malaysia.
Lawyers for the asylum seekers had argued that under the Migration Act,
Australia had to ensure countries met the same human rights obligations
that apply to asylum seekers processed here.
They argued that the Immigration Minister did not have the power to send asylum seekers
to a country that has no legal obligations to protect them.
They also argued that sending unaccompanied minors to Malaysia would breach
the minister's duty of care as their legal guardian to act in their best interests.
But Commonwealth Solicitor-General Stephen Gageler had argued the Government could lawfully declare Malaysia a safe third country even though it had no domestic or international legal obligations to protect asylum seekers.
The Government had wanted to send 800 asylum seekers to Malaysia in exchange for 4000 already processed refugees.
In killing off the Malaysian solution, the court found the Minister could
not have declared Malaysia as a country to which asylum seekers could be
taken for processing unless it met critical human rights standards.
The ruling came down in a 5-2 decision to uphold the current injunction on the Malaysia deal.
An international law expert, speaking outside the High Court today, said
while no further appeals were possible, the Government could still potentially make the scheme work.
Professor Donald Rothwell said the Government could change migration and immigration laws.
"It is always within the scope of Commonwealth powers to amend legislation in the Parliament," Prof Rothwell said.
Meantime 330 asylum seekers slated to leave Christmas Island for Malaysia will now stay at the detention centre.
Refugee advocate Ian Rintoul told Sky News today he was surprised by the decision.
"It's a welcome result, but it doesn't rule out further attempts to process refugees in third countries," he said.

come close to being refugees,gold rings and watches aplenty from what i
can see and non seem to be under nourished or dressed in ragged
clothing,what part of this picture denote's refugees ? not my idea of
what they are,ha,we are all being led down the garden path and the
politicaly correct and the bleeding hearts carry the day over common
sense,as per usual,how many more billion's of tax payer's money is going
down the toilet for this scam? and when it backfires it will be who's
fault?...

on Insiders this week. Can someone please draw a line of asylum
seekers coming off a Malaysian Airlines jumbo, red carpet on the tarmac,
a handshake from Gillard at the foot of the stairs handing each new
arrival a free pass to partner Tim's hairdressing studio. What a
laughable mess! And what a slap in the face for Gillard, a lawyer
herself, now the architect of a policy slapped down by the High Court...

A train line damaged by an earthquake
In 1917, one miner died and 5 were injured in an underground rock fall triggered by an earthquake in Kalgoorlie, Western Australia.
In the last 80 years, there have been 17 earthquakes in Australia registering 6.0 or more on the Richter Scale. This is a rate of about one earthquake every five years, compared to the world average of about 140 per year.

Here is a list of some of the major earthquakes to have occured in Australia in recent times:
1 March 1954, Adelaide, South Australia
Adelaide was awakened by a loud rumbling sound. This was followed by shaking, severe enough to crack walls and loosen plaster and chimneys from many houses. Although minor compared to many overseas quakes, the Adelaide earthquake was (at magnitude 5.4) severe enough to cause damage estimated at $350 million (1997 values). No serious injuries were reported.
October 1968, Meckering, Western Australia
One of the more serious Australian earthquakes in fairly recent years occurred at the small town of Meckering. Residents reported seeing ground waves as well as experiencing difficulty when driving as the 6.9 Richter magnitude earthquake struck. Old buildings collapsed, railway lines were buckled and pipelines fractured, and a 37 kilometres long fault scarp (up to 2.5 metres high) was caused. Sixteen injuries were reported and the total cost of damage estimated $50 million.
22 January 1988, Tennant Creek, Northern Territory
Significant earthquakes of magnitudes 6.3, 6.4 and 6.8 occurred near Tennant Creek in the Northern Territory. These resulted in large, long ground ruptures and a 35 kilometre fault (up to 2 metre displacement) which warped underground gas pipelines, but caused only minor damage to the hospital and some homes in the town.
28 December 1989, Newcastle, New South Wales
At 10.27am, Newcastle, Australia's sixth largest city, was partially devastated by a moderate earthquake measuring 5.6 on the Richter Scale. The Newcastle earthquake, the first lethal one in Australia, claimed 13 lives.
The devastation to buildings and other structures was extensive, which was unusual for a relatively-small magnitude earthquake. Although minor compared to many overseas quakes, the Adelaide earthquake was (at magnitude 5.4) severe enough to cause damage estimated at $350 million (1997 values). No serious injuries were reported.
October 1968, Meckering, Western Australia
One of the more serious Australian earthquakes in fairly recent years occurred at the small town of Meckering. Residents reported seeing ground waves as well as experiencing difficulty when driving as the 6.9 Richter magnitude earthquake struck. Old buildings collapsed, railway lines were buckled and pipelines fractured, and a 37 kilometres long fault scarp (up to 2.5 metres high) was caused. Sixteen injuries were reported and the total cost of damage estimated $50 million.
22 January 1988, Tennant Creek, Northern Territory
Significant earthquakes of magnitudes 6.3, 6.4 and 6.8 occurred near Tennant Creek in the Northern Territory. These resulted in large, long ground ruptures and a 35 kilometre fault (up to 2 metre displacement) which warped underground gas pipelines, but caused only minor damage to the hospital and some homes in the town.
28 December 1989, Newcastle, New South Wales
At 10.27am, Newcastle, Australia's sixth largest city, was partially devastated by a moderate earthquake measuring 5.6 on the Richter Scale. The Newcastle earthquake, the first lethal one in Australia, claimed 13 lives.
The devastation to buildings and other structures was extensive, which was unusual for a relatively-small magnitude earthquake.
