Fair Work Australia general manager Bernadette O’Neill is denying
Victorian police access to transcripts of interviews of witnesses who
gave evidence about alleged corruption involving Labor MP Craig Thomson.


She should be charged with obstruction of justice.

Fair Work Australia has been “investigating” Thomson for some three
years - longer than the investigation into the assassination of US
President John F. Kennedy.

Prime Minister Julia Gillard says Thomson, has her full support.

Those who don’t rely on Thomson’s Labor vote say it looks as if Fair
Work Australia is dragging its feet for blatantly political purposes.

Thomson is being investigated by both the Victorian and NSW police.

The Australian’s Ean Higgins reports that Victorian detectives believe
the transcripts, apart from being of considerable general assistance,
could potentially catch out some witnesses as lying under oath and
enable them to be charged with being accessories after the fact.

A source close to the Victorian police investigation has told The
Australian that because FWA conducted its interviews before many of the
more damaging allegations surrounding Thomson and his associates became
public over the past seven months, some witnesses may have presented a
different story at that time.

The source said it was Ms O’Neill’s refusal to provide the transcripts
that led to anger among Victorian police commanders who are seeking to
gather key evidence to bring charges against one or more individuals.

FWA has spent three years investigating alleged financial malpractice in
the national office of the Health Services Union, and specific
allegations that Thomson, when he was HSU national secretary between
2002 and 2007, misused his union credit card in a splurge of more than
$100,000 of personal spending including on prostitutes.

Thomson strenuously denies the allegations.

FWA interviewed a large number of serving and former union officials under oath, including, in 2010, Thomson.

Victorian police are investigating the same allegations with a view to
determining if Thomson committed fraud, and whether other union
officials were complicit.

In Senate estimates last month O’Neill defended the legal right of her
predecessor, Tim Lee, to refuse to speak to a senior NSW police
commander about the Thomson investigation.

NSW Strikeforce Carnarvon is investigating allegations Thomson and HSU
East general secretary Michael Williamson took secret commissions from a
graphic designer, John Gilleland, who has a $680,000 annual contract
with the union and whose premises were recently raided by police.
Thomson, Williamson and Gilleland deny any wrongdoing.

The Coalition yesterday stepped up pressure on the issue, with Tony
Abbott attempting to sheet home some responsibility to Julia Gillard,
who has deflected questions, saying FWA is an independent body.

“Here is a federal agency that is refusing to co-operate in a criminal
investigation and if the Prime Minister has no opinion on this, well
frankly, she becomes complicit in . . . what looks like a cover up of
some very, very low acts,” Abbott said.

Oposition workplace relations spokesman Eric Abetz called on FWA
president Iain Ross to direct O’Neill to co-operate with police.


He cited section 655(2) of the Fair Work Act, which says that the
president may disclose information “likely to assist in the
administration or enforcement of a law of the commonwealth, a state or a
territory”.


It should not be necessary to remind a senior public servant (or anyone else) that they have a duty to uphold the law.

The circumstances of the Thomson investigation stink.

If the Labor federal government’s agencies are not prepared to work with
police, why should members of the public feel they have a duty to help
whenever they can?

Gillard must act, the president of FWA Iain Ross must act.

If they do not, they are demonstrating contempt for the nation and its laws.

I remember being attacked when I warned of the strong links between Nazism and Germany’s green groups in the 1930s. The totalitarian instinct, and the disregard for the individual, seemed only too common to both ideologies.

Now, as the global warming faith develops, the links I warned off grow
far less tenuous. Take the latest idea - to breed a race of
super-greens. Yes, we’re back to eugenics again:

But actually, that’s false. Liao makes clear that his proposal include
modifying fetuses - a most coercive form of human engineering:

You might try to do it through a technique called preimplantation
genetic diagnosis, which is already used in IVF settings in fertility

sometimes happens by accident in vitamin overdose cases. In fact

influencing the competition between maternal and paternal genes, where
there is a height disparity between the mother and father.

eugenics - the modification of children on ideological grounds. What

Gun syndicate linked to Sydney post office

THREE people have been charged after
Australian and German detectives smashed an international gun-smuggling
syndicate alleged to have been run, at least in part, from a suburban
Sydney post office.

Police raided 11 properties in Sydney yesterday morning, including
Sylvania Waters post office, in the city's south, eight homes and an
import business.


They arrested three men, including a 30-year-old post office licensee,
a 21-year-old worker at the import business and
a 27-year-old telecommunications technician.


The men were charged with a raft of offences including supplying firearms,
aggravated possession of firearms and participating in a criminal group.


All were refused bail and are due to appear at Burwood and Sutherland local courts today.

It's alleged the trio were part of a syndicate importing Glock pistols from
Austria via a gun dealership in Remscheid, west Germany,
using falsified
documents.


Police began an investigation the operation in February after tracing guns found in Sydney, including a Glock linked to a shooting in Campsie in late January, to a batch made in Austria.

The weapons were traced to the German gun dealership, which is alleged to have
imported them to Australia using false consignment data.


Sylvania Waters post office is alleged to have been the end destination for the guns before they were distributed to bikie and Middle Eastern gangs across the city.


"We will be alleging these guns were being imported specifically for use by criminals, including outlaw motorcycle gang members and those in Middle Eastern organised crime groups," NSW Police Commissioner Andrew Scipione said in a statement.

"One firearm has been linked to a south-western Sydney shooting and we are
making further inquiries to see if others are similarly linked."


A fourth person, a 28-year-old woman, was also arrested in Sydney and was being questioned last night.

German detectives arrested a man in connection with the investigation after raiding a number of properties in Remscheid yesterday and seizing a number of documents and parcels.


Detectives involved in the Sydney raids also seized a parcel
containing 140 Glock magazines, seven firearms, ammunition,
drugs and computer equipment.

Senior officials blasted in report

VICTORIAN health workers' union fees were misused
including to fly officials and their spouses to a wedding,
an investigation has found.

During a spending spree of unauthorised payments, union officials also
gave $5000 to a colleague so she could campaign for US President Barack Obama.


A Fair Work Australia investigation found the
Health Services Union Victoria No.1 branch failed to keep records on
thousands of dollars of credit card transactions and "paid lip service"
to proper accounting practices.


Former branch secretary Jeff Jackson and
then-assistant secretary Shaun Hudson were slammed by the findings.


The report says in 2008 Mr Jackson authorised $5000 of union funds to be
paid into colleague Alex Hicks's personal bank account "because Ms Hicks
was campaigning for Barack Obama in the United States of America".


FWA also found HSU funds were used to pay for airfares and accommodation
for Mr Jackson, Mr Hudson and their spouses to attend a colleague's Sydney wedding
in 2008.


The report says during an interview over the spending,
Mr Jackson said it was "appropriate" for the HSU to pay for an official's spouse to travel
to a wedding of a union employee.


Dozens of other examples of broken rules are laid out in the FWA report, tabled by a Senate committee yesterday.

Mr Jackson told the Herald Sun last night he was "grateful" it had been released so former colleagues' claims could be tested in the Federal Court.


He said his enemies in the union movement ran a political campaign against
him, and he would contest claims in court rather than through the media.


The Herald Sun was unable to contact Mr Hudson.


The FWA investigation is one of two into the HSU, and took almost three years to complete.


The other investigation involves embattled Labor MP Craig Thomson

CRAIG Thomson's bid to take a second week of sick leave from parliament could prove painful for the Labor Party.

His mystery stomach bug has left the Coalition refusing to accept his sick note unless
it comes from a hospital - potentially leaving Labor one vote down in the finely balanced parliament and putting the passage of legislation at risk.


Mr Thomson is facing multiple investigations into claims he misused union credit cards
to visit prostitutes - claims he vehemently denies.


The manager of Opposition business Christopher Pyne told The Sunday Telegraph
there was no problem in granting Mr Thomson "a pair" for Monday on the basis of
a medical certificate provided by his general practitioner.


But the Opposition wanted further evidence of illness if Mr Thomson's leave period
was to be any longer.


"Our view is he needs to get a letter from the hospital," Mr Pyne said.

"We deal with pairs on a day-by-day basis. We assume if he can't attend
Parliament on Tuesday that he will have a letter from the hospital that
treated him in Canberra saying he has not yet recovered."


Last Tuesday, Mr Thomson fell ill in Canberra before parliamentary sittings
resumed, taking himself to a local hospital for tests.


He was granted a "pair" for the week by agreement with the Liberals, a common
practice for sick MPs which ensured Labor was not a vote down on key votes.


Labor's whip Joel Fitzgibbon later tweeted: "Looks like Craig Thomson has appendicitis.
May have to come out but he's fine."


The Prime Minister told journalists last week: "I understand he is anticipating
he will be right to be able to return to work in a day or two."


On Wednesday afternoon, a spokesman said Mr Thomson was "feeling better"
and awaiting test results.

But Mr Thomson was released from a Canberra hospital last week after the
tests failed to diagnose the cause of his severe stomach pains.

He has now obtained another doctor's certificate from a local GP.

Government whip Joel Fitzgibbon said he would be "very surprised" if the Coalition did not grant Mr Thomson a pair.

"Craig Thomson remains unwell. He has doctor's certificate covering him," Mr Fitzgibbon said.

"On a number of occasions within the period of this parliament we have given their MPs long-term leave for medical conditions and we've never insisted on medical certificates,"
he said.


"I've taken them at their word. At the end of the day, pairs are no more than a gentleman's
agreement and we've always entered into those agreements in good faith.


"We've done our own research that clearly shows the opposition has been far more dependent on the pairing system than have we.


"If they are considering denying him a pair, they really should reflect on that."


Mr Thomson and his office did not return calls yesterday.

On Friday, a Fair Work Australia report said a "dysfunctional" branch of
the Health Services Union spent unauthorised member funds on airfares,
the wedding of a colleague and granting one official a $15,000 pay rise.

Another report investigating matters regarding Mr Thomson is yet to be released.


Other MPs are not attending parliament this week,
including Independent Bob Katter,
who is campaigning in the Queensland election, and Labor's Michelle Rowland, who is
on maternity leave.

WITH proposed threats to Australian media freedom making
international press watchdogs register their deep concerns, the Gillard
government has so far refused to comment when asked about the harsh
recommendations contained in the Finkelstein inquiry into the media.

Former Federal Court judge Ray Finkelstein delivered his 467-page
tome to Communications Minister Stephen Conroy last month - not a peep
out of Conroy, nor anyone else in the Cabinet.

Nor, surprisingly, given the report’s extraordinary call for a
government-funded News Media Council with punitive powers, including
jailing, have we heard from any of those who so bitterly claimed (in
uncensored books and articles) that they were being silenced during the
years of the Howard government.

Make no mistake - this is a political weapon.

The Finkelstein inquiry’s genesis was in complaints from the Greens
leader Bob Brown, Labor’s principal partner in its minority government.

Brown, Prime Minister Julia Gillard and many of her ministers are
extremely sensitive to criticism.


Finkelstein, advised by several campuses of academics, has provided
the government with a blunt instrument which, if used, would set the
notion of an Australian free press back several centuries.

His new body would replace the Australian Press Council, which
currently hears complaints against the print media, and take over
hearing radio and television complaints from the Australian
Communications and Media Authority.

It would have a full-time chair and 20 part-time members, half
appointed by the government-selected authority and half from those who
have worked in the media - so long as they are not “managers, directors
and shareholders of media organisations”. He wants to give it legal
powers that would compel compliance, punishable in “the usual way” as
contempt of court - imprisonment.

Having ploughed through his report, it’s worth noting what’s
missing: the background to the Press Council’s development and almost
any recognisable media voices.

Les Carlyon, a former editor of The Age and a former editor-in-chief
of The Herald and Weekly Times (a position I have also held) and
multiple prize-winning author of Gallipoli, told me last week he found
it “a frightening document”.

“If this had come out 20 years ago, you would assume the author knew
nothing about Australia’s constitutional conventions,” he said.

The biggest problem with the local media, he suggested - just as it
was when the great American essayist HL Mencken was writing about the
press - is “careless and sloppy reporting and bad writing”.

“This report isn’t going to help overcome those problems in any way,” Carlyon said.

One of the best respected names in the Australian media is Graham
Perkin, whose name now graces an award. Before he died in 1975, Perkin
was one of those who fought for the formation of the Press Council,
which occurred in 1976.

While Perkin is held up as a paragon by many Labor supporters today,
most have forgotten that he pursued a vendetta against the Whitlam
government during which he authorised the payment of huge sums of money
to sources for evidence that incriminated cabinet members in illegal
fundraising.


On October 15, the day before he died, Perkin published an editorial
he had written titled “Go now, go decently”, in which he thundered: “We
will say it straight and clear and at once. The Whitlam government has
run its course; it must go now, and preferably by the honourable course
of resignation - a course which would dispel all arguments about
constitutional proprieties, historic conventions and ‘grabs’ for power.
It must go because it no longer has the degree of public support and
acceptance that permits governments to govern effectively.”


Carlyon compared it to a 1992 Herald-Sun front page, titled “Fight
for a future”, in which the paper noted unemployment had reached 11.8
per cent and urged premier Joan Kirner to call an election.


Both editorials, he said, followed campaigns that Finkelstein would
object to, according to his report which supported bans on “obsessive
attempts to influence government policy by day-after-day repetition of
issues with little or no new information of news value” or “opposition
to government policy which is commercially driven”.

Both editorials followed campaigns against governments and policy
and both could be deemed commercially driven because both The Age and
The Herald-Sun took the view that the governments they were arguing
against were economically disastrous."What’s more,” he added, “The
Washington Post surely would have offended Finkelstein with its lengthy
campaign on Watergate and the (London) Sunday Times would have upset him
with its campaign against the use of the drug thalidomide.”

I believe there is a lot of ignorance and elitist arrogance in the
Finkelstein report but the gross lack of understanding of the practice
of news-gathering, the importance of deadlines, the need for speed, for
clear writing, for information and for entertainment shines through.

Thalidomide was a morning sickness drug later found to cause foetal
abnormalities. It was withdrawn in 1961 and in 1968, after the Sunday
Times campaign, families finally won compensation.


Carlyon’s had more than 50 years in the media.

Both of us know veterans
whose knowledge should have been sought
but who were overlooked in favour of academics.


Among the most knowledgeable is former Sunday Herald-Sun editor Alan
Howe, whose tenure saw circulation grow in a record 25 successive
six-monthly audit periods.

There are other legends whose knowledge would have been invaluable
to anyone seeking to ensure our hard-fought press freedoms endure in a
time of shrinking sales and revenue.

Carlyon said he didn’t recognise a single byline
when he read the names of those consulted by Finkelstein.


The Government could avoid looking even more dysfunctional if an
“administrative oversight” ensures this report is quietly shelved.

The ABC reports claims that Thomson, accused of using a union credit card
to pay for prostitutes, turned against a $2.7 million jobs project in his electorate after it refused to hire his ex wife. It has now collapsed:

The superannuation gravy train

Quelle surprise! Businesses are just now expressing concern about
the costs of the increase in the superannuation guarantee from 9 to 12
per cent. Where were the business lobby groups since this policy was
proposed years ago. Catallaxy readers have seen this topic being

But it only seems now, at the 11th hour, that businesses are waking up to the full implications of increasing the superannuation guarantee.

Let’s face it, the business lobby groups are hopelessly conflicted.
Heather Ridout, for example, was the head of the Australian Industry
Group but enjoyed a position on the board of Australian Super. As has
been noted in a number of Catallaxy blogs, Union leaders enjoy
comfortable and well remunerated positions as trustees of superannuation
funds.


This is the principal-agent problem writ large and in three
directions. The Government is not representing the interests of
taxpayers. Business lobby groups are not representing the interests of
businesses. And Unions are not representing the interests of workers.


Now these cowboys – who have over invested in unlisted property trusts – want more money.

Increasing the superannuation guarantee is one of the worst and most
destructive policies introduced by this government. As Judith has noted,
it was not recommended by the Henry review. As I have noted, it would
lead to people having higher incomes in retirement than during their
working lives (if, that is, the funds have been wisely invested and earn
a descent return – something that cannot be assumed over the typical
working life of today’s younger workers).


The burden of the measure falls on the workers, increasing the cost
of employing them and (other things being equal) a lower rate of
