NURSES at Victorian hospitals are gagged from speaking out against
violence perpetrated against them at work and fear management, an
inquiry has heard.

Dandenong Hospital emergency department nurse Leslie Graham said
she suffers either physical or verbal abuse at work about every second
day.
Ms Graham told a parliamentary inquiry into security at the
state's hospitals that, in addition to verbal aggression, she and her
colleagues get bitten, punched and slapped and have objects thrown at
them.
"We have people ... pull their IVs out and throw
blood-stained cannulas, sharps, any kind of weapon they can get their
hands on, chairs, at the nursing staff," she said yesterday.
"You just press your duress (alarm) and run away."
Ms
Graham said despite frequently being subjected to violence she had
never reported it to police because she thought it would cause issues
with management.

"If I had a serious issue against myself I would report that to
the police, but I know that a lot of people are afraid of the
management of different hospitals," she said.
"(A nurse who) got
strangled never reported it to the police, and we weren't allowed to
make any of the public aware of the violence that we ... come up
against because then we could end up in court."
Ms Graham said
the design of the new $25 million emergency ward at the hospital, which
is run by Southern Health, also contributed to violence against staff.
There were instances where staff were backed into corners and unmonitored corridors, she said.
"We
have just had a brand-new emergency department that has been designed
and built not by anyone who has ever worked in an emergency
department," Ms Graham said.
The inquiry, held by state
parliament's drugs and crime prevention committee, was ordered by
Police Minister Peter Ryan after criticism of the coalition's
pre-election promise to station armed guards at emergency wards.
Ms
Graham said armed guards would not help the situation at her hospital
and there needed to be more unarmed security staff instead of just one
guard working between 6pm and 3am.
Royal Children's Hospital
emergency department nurse Peter Sloman said although the hospital's
new facility was more secure, there were still design problems.
The hospital's director of emergency services Simon Young said he did not support the introduction of armed guards.
Australian
Nursing Federation (ANF) Victorian branch assistant secretary Paul
Gilbert said the $21 million the government had pledged for 120 armed
guards could fund an extra 235 full-time nurses in emergency
departments.
ANF Victoria occupational health and safety
coordinator Kathy Chrisfield said introducing armed guards into
emergency departments would simply create another hazard.

LEGISLATION to tackle workplace bullying across Australia should be
introduced following the adoption of Brodie's Law in Victoria, advocates
say.

The Victorian law was named for 19-year-old Brodie Panlock who took her own life in 2006 after being bullied as a waitress.
The
workplace bullying laws were passed in Victoria in June and Ms
Panlock’s parents, Damian and Rae, said at the time they wanted to see
federal laws to make the offence punishable by up to 10 years' jail in
any state.
Employment law firm Maurice Blackburn has today called on the federal government to introduce national laws.
Maurice
Blackburn employment lawyer Josh Bornstein said workplace bullying was
present in all professions but was not specifically addressed by any
federal law.
"Workplace bullying involves degrading, belittling,
humiliating and threatening behaviour; in some cases it spills over into
violence," Mr Bornstein said.

Mr
Bornstein said the productivity commission had estimated bullying and
harassment cost the Australian economy between $6 billion and $36
billion each year.
Mrs Panlock said in June Brodie’s Law sent "a clear message that bullying is a cowardly act and won't be tolerated".
"We'd like this law to be across the board from state to state," she said.
"I just hope that no family ever has to go through this again."
A Facebook page has been set up to support the call for federal laws.

THE Health Services Union paid tens of thousands of dollars to
federal MP Craig Thomson last year in a settlement, despite allegations
he spent union funds on prostitutes.

The revelation means the embattled MP has now double dipped from
Labor and the unions - taking more than $150,000 from Labor for his
legal fees against Fairfax, and taking tens of thousands more from the
HSU in a settlement after the allegations.
Mr Thomson had been
suing the HSU for defamation and for an alleged $190,000 in entitlements
for leave he claimed he was owed, which the union withheld after the
credit card allegations came to light.
Mr Thomson is accused of
stealing from the unions, including spending thousands on his credit
card hiring prostitutes and withdrawing more than $100,000 in cash
advances from the card from 2002 to 2007.
The union referred the matter to Fair Work Australia in 2008, a year after Mr Thomson entered Parliament.

But last year the union settled on the suits Mr Thomson had taken
against the union, paying him tens of thousands of the $190,000 he
claimed, sources have confirmed.
NSW Labor spent more than $150,000 on Mr Thomson's legal fees when he dropped a defamation suit against Fairfax.
Senior
Labor sources have said they paid Mr Thomson's fees amid concern he
would go bankrupt, which would have seen him ineligible to remain in
Parliament, and could have brought down the Gillard Government.
Union
sources have raised concerns a Fair Work Australia investigation into
the alleged rorts within the union has taken two years.
They are
also concerned the inquiry has not interviewed several people on the
Health Services Union's national executive who may have information.
Mr
Thomson's pregnant wife, radio newsreader Zoe Arnold, has taken early
leave from her radio station Sea FM on the Central Coast amid the stress
of the scandal.

THE Thomson prostitution affair intensified yesterday as the major
parties traded blows over the scandal that threatened to derail the
Gillard Government.

Trade Minister Craig Emerson accused the Opposition of capitalising on sleaze for political points.
He
warned Opposition MPs to "back off" over the mounting scandal and
claimed Opposition Leader Tony Abbott was trying an "easy, sleazy path
to The Lodge".
Mr Abbott returned fire during an address to the
Liberal Party State Council in Hobart, asserting that calling the
Gillard Government the worst since Gough Whitlam's was "very unfair on
Gough Whitlam".
"Gough Whitlam would never have run away from
parliamentary scrutiny the way this Prime Minister has over the last
fortnight," Mr Abbott said.
He claimed that a dirty shovel placed
on the doorstep of the home of HSU secretary Kathy Jackson, who
referred former union chief Craig Thomson to police amid claims of
fraud, was the work of operatives within the ALP.

inside the Labor Party," Mr Abbott said.
Mr Emerson also hit back
at Nationals leader Warren Truss, who yesterday said the Government
stank of corruption, as NSW police continued to investigate Labor MP
Craig Thomson over claims he used a union credit card to pay
prostitutes.
"If the Nationals leader has evidence of corruption
in the Labor Party, he should do the right thing and take that evidence
to the police," Mr Emerson said.

THE union boss who blew the whistle on Labor MP Craig Thomson has
been offered police protection after a menacing threat at her Melbourne
home.

Kathy Jackson, whose actions could bring down the Gillard
Government, last night vowed to take on the "scumbags" who left a
dirt-covered shovel on her doorstep.
"Give it your best shot," the Health Services Union national secretary said, in a defiant challenge to her unknown attackers.
The Courier-Mail can
also reveal that Mr Thomson's initial defence - that he was interstate
when his credit card was used to hire prostitutes - has been severely
challenged by court records.
In a formal defence against the
allegations - contained in a May 2009 letter to the HSU lawyers - the
Labor MP argued he could not have spent $2475 on a Sydney escort agency
on April 9, 2005, because "I was in Melbourne".

But court records show that he rang the escort agency on April 7/8
and also paid by credit card on those dates - before later reversing the
charges and paying on a different credit card.
Ms Jackson
referred allegations that Mr Thomson had spent $150,000-plus of union
funds on prostitutes and other personal items to the NSW Police on
Wednesday.
The union official has refused police protection and
said she wouldn't "lock herself away", also claiming she was targeted
because she was a woman in the male-dominated union world.
"Women
should not be subjected to this sort of conduct," she said. "I'm a big
girl and if they think that this is going to stop us, then they have
picked the wrong girl."
Mike Williamson, the HSU national
president who is reported to have initially opposed Ms Jackson in her
attempts to have the Thomson matter referred to police, said: "I think
it was an appalling incident and I hope the police catch whoever was
involved very quickly."
The sinister twist came as the Coalition
called on Prime Minister Julia Gillard to explain when she had first
learned of the allegations against Mr Thomson, whose resignation would
likely see the demise of the Government.
"She owes it to the
public to tell us what she knew, when she knew it and what she did about
it," Opposition Leader Tony Abbott said yesterday.
Former
Industrial Registrar Doug Williams last night repeated his assertion
that Ms Gillard's chief of staff, Ben Hubbard, had rung him in the early
months of 2009 to inquire about Craig Thomson.
"I clearly believe
that the first time I heard of Mr Thomson, in relation to any inquiries
I was making, was in the phone call I received from Mr Hubbard," Mr
Williams said.
It can also be revealed that the HSU national
executive admitted there was a serious problem with the former national
secretary's credit card as early as March 2008, when it imposed a limit
on Kathy Jackson's credit card of $10,000 and limited other employees to
$5000.
Leaked HSU minutes show that the union imposed a rule that
there were to be "no cash withdrawals" from HSU credit cards and that
receipts and tax invoices were to be kept for all credit card
expenditure.
The Prime Minister yesterday denied having any prior
knowledge of the allegations against Mr Thomson before they were made
public in April 2009.
She said such a phone call would have been
"unremarkable" and part of regular communication between Government
advisers and public servants.
The Government also tabled a Senate
document that said Mr Williams had rung Mr Hubbard on April 8, 2009 -
the day before the first article appeared.
