AFPINTERNET giant Facebook is accessing
smartphone users' personal text messages,
an investigation revealed today.
Facebook admitted reading text messages belonging to smartphone users
who downloaded the social-networking app and said that it was accessing the data
as part of a trial to launch its own messaging service,
The (London) Sunday Times reported.

Other well-known companies accessing smartphone users' personal data -
such as text messages - include photo-sharing site Flickr, dating site Badoo and
Yahoo Messenger, the paper said.

It claimed that some apps
even allow companies to
intercept phone calls -
while others, such as YouTube,
are capable of remotely accessing and
operating users' smartphone cameras
to take photographs or videos
at any time.

Security app My Remote Lock and the app Tennis Juggling Game were among
smaller companies' apps that may intercept users' calls, the paper said.

Emma Draper, of the Privacy International campaign group, said,
"Your personal information is a precious commodity, and companies will
go to great lengths to get their hands on as much of it as possible."

More than 400,000 apps can be downloaded to Android phones,
and more than 500,000 are available for iPhones - with all apps downloaded
from Apple's App Store covered by the same terms and conditions policy.

According to a YouGov poll for the newspaper, 70 per cent of smartphone users
rarely or never read the terms and conditions policy when they download an app.

Julia Gillard will be glad when Monday’s ballot is over and she can get
on with dealing with some of the real issues facing her government:

POLICE have discovered further unusual credit cards associated with
the Health Services Union’s president, Michael Williamson,
as they continue to investigate allegations he and
the former general secretary Craig Thomson received secret commissions
via credit cards supplied to them by a major contractor to the union.

Meanwhile, in a separate development, early yesterday morning detectives

Gilleland, 65, and his wife, Carron, 51.

Mr and Mrs Gilleland’s company, Communigraphix, which they run from

POLICE have discovered further unusual credit cards
associated with the Health Services Union's

The Herald has previously reported Mrs Gilleland
allegedly complained to senior union officials that Mr Williamson had
''run amok'' with the credit card. ''He even paid his private school
fees on it; this was not part of the deal,'' Mrs Gilleland allegedly
said. Mrs Gilleland yesterday denied saying these things happened or
that she ever said it.

Offering or receiving a benefit as an inducement to act
in a certain way in business dealings may constitute a criminal offence
that can attract penalties of up to seven years imprisonment.

Police arrived at the two-storey Barrenjoey Road house
shortly before 7am, and stayed for more than eight hours. They left
carrying eight boxes of documents and two computers.

Mr Williamson, who is on paid leave from the union, and
Mr Thomson, who became the federal member for Dobell in 2007, have
denied any wrongdoing.

Yesterday's police raid was not Mr Gilleland's first brush with the law.
In 1984 he and his brother, Ian, were arrested by federal police
over their alleged role in using their printing company
to produce counterfeit German currency.
While John Gilleland was acquitted by a jury in 1986,
at a subsequent trial Ian was sentenced to five years' jail.

Mr Thomson is the subject of two other investigations
being conducted by the Victorian Police and Fair Work Australia into
allegations he used his union-issued credit card to withdraw $100,000
in cash advances and to pay for prostitutes. This is a separate card to
the one that was the subject of yesterday's police raid.

Roxon verbals Rudd after being caught asleep

Professor Sinclair Davidson finds Attorney General Nicola Roxon rewriting history to smear Kevin Rudd:

This is what Nicola Roxon was saying about the Rudd era.

Roxon says on Valentine’s Day 2010, the then prime minister
decided he wanted to take over the entire health system. He gave four
days’ notice and had no legal advice or even a cabinet submission.

“On another occasion he suggested to us actually having a referendum
about taking over the health system, having it at the same time as the
2010 election, knowing full well and agreeing that that referendum would
be lost but thought it would be a good tool to be able to win the
election,” Roxon told Sky News.
But hang on, says Davidson. Rudd had made this referendum a promise in
his 2007 campaign. How dopey was Roxon, Rudd’s health minister, not to
have prepared for it three years later?

don’t think many people doubt the fact that Mr Rudd, behind the scenes

Labor movement, to that movement which put him into parliament and
expects better from him.

James Button was a Rudd Government speechwriter and is right to warm of
Kevin Rudd’s astonishingly dysfunctional style of management - or even
personal relations:

rudeness and contempt. He was vindictive, intervening to deny people
appointments or preselections, often based on grudges that went back
years.

He made crushing demands on his staff, and when they laboured through
the night to meet those demands, they received no thanks, and often the
work was not used. People who dared stand up to him were put in “the
freezer” and not consulted or spoken to for months. The prodigious
loyalty of his staff to him was mostly not repaid. He put them down
behind their backs. He seemed to feel that everyone was always letting
him down. In meetings, as I saw, he could emanate a kind of icy rage
that was as mysterious as it was disturbing.

He governed by - seemed almost to thrive on - crisis. Important papers
went unsigned, staff and public servants would be pulled onto flights,
in at least one case halfway around the world, on the off chance that he
needed to consult them. Vital decisions were held up while he struggled
to make up his mind, frequently demanding more pieces of information
that merely delayed the final result. The fate of the government seemed
to hinge on the psychology of one man.
</blockquote>I can quite understand why Labor MPs - in their own interests as well as
those of the nation - are desperate to keep this man out of the Prime
Minister’s office.

The question is: why on earth did they let him in in the first place.

about Rudd was there to be seen even before he became Prime Minister.
What so many in the Left now agree about Rudd was once - when written by

hard-working man does have the glass jaw that will make him
unpredictable in high office.

which originated when documents
relating to child abuse
were shredded by
the Goss Queensland Labor Govt in 1990.

The documents related to an
inquiry into the former
John Oxley Youth Detention Centre headed by
former magistrate Noel Heiner in 1989.

One of the victims who was pack raped
while in Qld Govt care was recently paid $120,000
and is said to be travelling to Canberra
to make her case known.

As Piers Akerman explains – a 2,800 page audit document pulling together
the whole saga and composed by Sydney QC David Rofe was emailed to all
Senators on Australia day last month. Some leading figures in powerful
positions now are involved.

The Parliamentary Standing Committee on Legal and Constitutional Affairs in 2004 posted documents on the subject – look for Volume 2. That committee no longer exists.
Anybody concerned could write to their Senators and ask what they intend doing.

Senators receive Heiner allegations

Meticulously prepared allegations of
the most serious misconduct by some of
the nation’s most senior public officers,
including
the Governor General Quentin Bryce,
the Foreign Minister Kevin Rudd,
and a raft of Queensland jurists
have been received
by every member of the Senate.

The allegations were contained in the Rofe Audit of the long-running
Heiner Affair and e-mailed to every Senator on Australia Day.

The affair began with the rape of a 14-year-old Aboriginal girl
who was in the custody of the Queensland government.

Though guilt was admitted, no charges were ever laid and evidence
prepared for an inquiry into the juvenile justice system by former
magistrate Noel Heiner was subsequently ordered to be destroyed by
Queensland’s Goss government Cabinet.

For the past 22 years, the victim (who was paid about $120,000 in hush
money by the Queensland government last year) has sought to have her day
in court.

She is expected to travel to Canberra to make her case personally after Parliament resumes tomorrow.

Last year the Senate Privileges Committee voted to bury the matter but members and staff had read the submissions.

The Clerk of the Senate, Dr Rosemary Laing, in Advice 47, wrote last
June that “there is no doubt the matter raised is very serious”.

Though the Clerk’s advice was made public, the submission on which her advice based was kept confidential - until now.

An attempt to have the matter debated in the Senate was stopped by the
Labor Party and the Greens, with former Family First Senator Steven
Fielding voting to stop the matter being raised.

The allegations raised about the Governor General Quentin Bryce’s
conduct are far more serious and pertinent than those which led to
former Governor General Peter Hollingworth’s resignation in 2003.

The Rev Dr Hollingworth was driven out of office after a vindictive
campaign by senior members of the Labor Party who claimed he was not a
fit and proper person to hold the post of Governor General.

In the extensive 2,800-page document, titled the Heiner Affair Papers,
it is alleged (among other things) that
Ms Bryce did not apply the law equally in the matter of
destruction of evidence when she was governor of Queensland in 2005.

The extensive secret submission was written by senior Sydney QC David Rofe.

A number of senators have confirmed receiving the massive document.

The general distribution of the material places the Senate and the
government in a very difficult position.
It is impossible for MPs to “unknow” what they have read.

Senior parliamentary officers say it is open for Ms Bryce to request a
copy of the papers, indeed, arguably, she is duty bound to do so
urgently given the serious nature of the charges and the fact that every
senator is now in receipt of allegations which question her integrity
and fitness to hold office.

It would also appear that the Senate will have to “send” a message to
the House of Representatives about the material as it also contains
adverse allegations about a member of the Lower House, Rudd.

Parliamentary sources say that they are reviewing the Hollingworth
resignation and the handling of allegations made against the former
(now deceased) High Court Justice Lionel Murphy to prepare advice for
the Gillard Labor-minority government.

This move dramatically increases the pressure on the government and the
Opposition. Members of the public know more about the Heiner Affair than
MPs wish, now there is no reason for Senators to plead ignorance.

The allegations are extremely serious and must be tested
or the taint will cripple the machinery of government.

Police this morning raided the house of the man accused
of providing secret commissions to the Health Services Union's former
general secretary Craig Thomson and the union's head Michael Williamson.

Detectives from Strike Force Carnarvon executed a search
warrant at the Palm Beach house of printer John Gilleland, 65, and his
wife, Carron, shortly before 7am today.

Several hours later, police from the computer crime squad arrived to assist in the search of the Gillelands' house.

A Herald investigation last year revealed that
Mr Williamson and Mr Thomson were provided with American Express cards
by Mr Gilleland, who runs a graphic design and printing business.

The credit cards were issued in the names of Mr Thomson
and Mr Williamson, but were attached to Mr Gilleland's account and the
bills incurred on those cards were allegedly paid for by Mr Gilleland.

The Herald has previously reported that Mrs
Gilleland allegedly complained to senior union officials that Mr
Williamson had "run amok" with the credit card.

He even paid his private school fees on it; this was not
part of the deal," Mrs Gilleland allegedly said. Mrs Gilleland today
denied that this occurred or that the converstation ever took place.

Mr Gilleland's company, Communigraphix, which he runs
from his two-storey house in Barrenjoey Road, receives $680,000 a year
to produce 10 issues of the union's newsletter, the Health Standard.

Either offering or receiving a benefit as an inducement
to act in a certain way in business dealings may constitute a criminal
offence, which can attract penalties of up to seven years' imprisonment.

Mr Williamson, who is on paid leave from the union, and
Mr Thomson, who became the federal member for Dobell in 2007, have
denied any wrongdoing.

This morning's police raid is not the printer's first brush with the law.

In 1984, he and his brother, Ian, were arrested by federal police
over their alleged role in using their printing company to produce
counterfeit German currency.

The quality of the notes was so good that they were given a seven out of 10 rating by the Reserve Bank.

While John Gilleland was acquitted by a jury in 1986, at a
subsequent trial, Ian was found guilty and sentenced to five years'
jail.

Mr Thomson is subject of two other investigations being
conducted by the Victorian Police and Fair Work Australia into
allegations that he used his union-issued credit card to withdraw
$100,000 in cash advances and to pay for prostitutes. This is a separate
card to the one that was the subject of today's police raid.

dysfunctional” and hence he was deposed. So someone who was at the time
known to run a “chaotic and dysfunctional” administration is then given
the job as foreign minister representing Australian interests abroad.

AFPINTERNET giant Facebook is accessing
smartphone users' personal text messages,
an investigation revealed today.
Facebook admitted reading text messages belonging to smartphone users
who downloaded the social-networking app and said that it was accessing the data
as part of a trial to launch its own messaging service,
The (London) Sunday Times reported.

Other well-known companies accessing smartphone users' personal data -
such as text messages - include photo-sharing site Flickr, dating site Badoo and
Yahoo Messenger, the paper said.

It claimed that some apps
even allow companies to
intercept phone calls -
while others, such as YouTube,
are capable of remotely accessing and
operating users' smartphone cameras
to take photographs or videos
at any time.

Security app My Remote Lock and the app Tennis Juggling Game were among
smaller companies' apps that may intercept users' calls, the paper said.

Emma Draper, of the Privacy International campaign group, said,
"Your personal information is a precious commodity, and companies will
go to great lengths to get their hands on as much of it as possible."

More than 400,000 apps can be downloaded to Android phones,
and more than 500,000 are available for iPhones - with all apps downloaded
from Apple's App Store covered by the same terms and conditions policy.

According to a YouGov poll for the newspaper, 70 per cent of smartphone users
rarely or never read the terms and conditions policy when they download an app.

Professor Sinclair Davidson finds Attorney General Nicola Roxon rewriting history to smear Kevin Rudd:

This is what Nicola Roxon was saying about the Rudd era.

Roxon says on Valentine’s Day 2010, the then prime minister
decided he wanted to take over the entire health system. He gave four
days’ notice and had no legal advice or even a cabinet submission.

“On another occasion he suggested to us actually having a referendum
about taking over the health system, having it at the same time as the
2010 election, knowing full well and agreeing that that referendum would
be lost but thought it would be a good tool to be able to win the
election,” Roxon told Sky News.
But hang on, says Davidson. Rudd had made this referendum a promise in
his 2007 campaign. How dopey was Roxon, Rudd’s health minister, not to
have prepared for it three years later?

James Button was a Rudd Government speechwriter and is right to warm of
Kevin Rudd’s astonishingly dysfunctional style of management - or even
personal relations:

rudeness and contempt. He was vindictive, intervening to deny people
appointments or preselections, often based on grudges that went back

work was not used. People who dared stand up to him were put in “the
freezer” and not consulted or spoken to for months. The prodigious
loyalty of his staff to him was mostly not repaid. He put them down

him down. In meetings, as I saw, he could emanate a kind of icy rage
that was as mysterious as it was disturbing.

He governed by - seemed almost to thrive on - crisis. Important papers
went unsigned, staff and public servants would be pulled onto flights,
in at least one case halfway around the world, on the off chance that he
needed to consult them. Vital decisions were held up while he struggled
to make up his mind, frequently demanding more pieces of information
that merely delayed the final result. The fate of the government seemed
to hinge on the psychology of one man.

those of the nation - are desperate to keep this man out of the Prime
Minister’s office.

The question is: why on earth did they let him in in the first place.

desperate to seem perfect, he seems to panic at his imperfections.

He has now little time to remake himself before the public starts to
notice, too, and to wonder if this highly intelligent, ferociously
hard-working man does have the glass jaw that will make him
unpredictable in high office.

Just three weeks ago on the ABC, Swan said: “The great bulk of the
coverage that I read is just completely divorced from reality ... but
that’s the media environment we live in at the moment.”

Since then, many in the media have been vindicated and Swan has
completely changed his version of reality. Some media were pinpointing
the truth, and the politicians were hiding it.

As Piers Akerman explains – a 2,800 page audit document pulling together
the whole saga and composed by Sydney QC David Rofe was emailed to all
Senators on Australia day last month. Some leading figures in powerful
positions now are involved.

The Parliamentary Standing Committee on Legal and Constitutional Affairs in 2004 posted documents on the subject – look for Volume 2. That committee no longer exists.

the most serious misconduct by some of
the nation’s most senior public officers,
including
the Governor General Quentin Bryce,
the Foreign Minister Kevin Rudd,
and a raft of Queensland jurists
have been received
by every member of the Senate.

The allegations were contained in the Rofe Audit of the long-running
Heiner Affair and e-mailed to every Senator on Australia Day.

The affair began with the rape of a 14-year-old Aboriginal girl
who was in the custody of the Queensland government.

Though guilt was admitted, no charges were ever laid and evidence
prepared for an inquiry into the juvenile justice system by former
magistrate Noel Heiner was subsequently ordered to be destroyed by
Queensland’s Goss government Cabinet.

For the past 22 years, the victim (who was paid about $120,000 in hush
money by the Queensland government last year) has sought to have her day
in court.

She is expected to travel to Canberra to make her case personally after Parliament resumes tomorrow.

Last year the Senate Privileges Committee voted to bury the matter but members and staff had read the submissions.

The Clerk of the Senate, Dr Rosemary Laing, in Advice 47, wrote last
June that “there is no doubt the matter raised is very serious”.

Though the Clerk’s advice was made public, the submission on which her advice based was kept confidential - until now.

An attempt to have the matter debated in the Senate was stopped by the
Labor Party and the Greens, with former Family First Senator Steven
Fielding voting to stop the matter being raised.

The allegations raised about the Governor General Quentin Bryce’s
conduct are far more serious and pertinent than those which led to
former Governor General Peter Hollingworth’s resignation in 2003.

The Rev Dr Hollingworth was driven out of office after a vindictive
campaign by senior members of the Labor Party who claimed he was not a
fit and proper person to hold the post of Governor General.

In the extensive 2,800-page document, titled the Heiner Affair Papers,
it is alleged (among other things) that
Ms Bryce did not apply the law equally in the matter of
destruction of evidence when she was governor of Queensland in 2005.

The extensive secret submission was written by senior Sydney QC David Rofe.

A number of senators have confirmed receiving the massive document.

The general distribution of the material places the Senate and the
government in a very difficult position.
It is impossible for MPs to “unknow” what they have read.

Senior parliamentary officers say it is open for Ms Bryce to request a
copy of the papers, indeed, arguably, she is duty bound to do so
urgently given the serious nature of the charges and the fact that every
senator is now in receipt of allegations which question her integrity
and fitness to hold office.

It would also appear that the Senate will have to “send” a message to
the House of Representatives about the material as it also contains
adverse allegations about a member of the Lower House, Rudd.

Parliamentary sources say that they are reviewing the Hollingworth
resignation and the handling of allegations made against the former
(now deceased) High Court Justice Lionel Murphy to prepare advice for
the Gillard Labor-minority government.

This move dramatically increases the pressure on the government and the
Opposition. Members of the public know more about the Heiner Affair than
MPs wish, now there is no reason for Senators to plead ignorance.

The allegations are extremely serious and must be tested
or the taint will cripple the machinery of government.

As Her Majesty's shadow attorney-general for the State of Tasmania,
I wish to raise a matter of injustice which has concerned me greatly,
and I will be, with the consent of the minister, tabling in the House and
making available to Hansard, the full article written by Australia's leading writer,
Piers Akerman, and published nationally under the headline 'Tragic tale needs ending'.
It relates to what has become known as the 'Heiner affair'.

It arises in Queensland but it is a matter of concern to all in Australia who
are committed to the pursuit of justice. The article speaks for itself, but I am grateful to
the minister for allowing me to table it because it will save me reading it into Hansard.

Piers Akerman puts a very strong case for a proper judicial inquiry
into a shocking injustice, an injustice which has been covered up for 19 years.
It was raised at the Standing Committee of Shadow Attorneys-General meeting
in Sydney on Friday, which I attended;
it was chaired by the Commonwealth Attorney-General, the Honourable Philip Ruddock MP.

It was further raised at the national conference of Australians for a Constitutional Monarchy, which I addressed in Sydney the following day.

I seek leave to table the article by Piers Akerman and have it incorporated into Hansard.
I commend it to all members. If you accept, as I do, that the case here is overwhelming,
then the matter will be listed for proper debate in this Parliament at a later time.
Justice delayed is justice denied. The girl who suffered this massive injustice needs to
have the matter put right and I appeal to all of you to read the article carefully and
I hope you will support me when I intend to bring the matter back to the Parliament
for debate later this session.

'Tragic tale needs ending
Federal Opposition leader Kevin Rudd may be called to answer questions
relating to the destruction of evidence as a police investigation into the rape of
Queensland girl 19 years ago gains new momentum.

The girl, who we will call Alice, was just 14 at the time and resident at the
John Oxley Youth Detention Centre, in the care of the Queensland Government,
when she was gang raped by other inmates.

Though some of the rapists confessed, no charges were pressed and the police
inquiry at the time was at best belated and perfunctory.

Alice's tragic story is but one strand of this horror,
the other is the Goss ALP government's attempt to
ignore her plight and bury the incident without trace.
That attempt began when an investigation directed by former magistrate Noel Heiner
and launched by the Cooper National Party government was shut down by the Goss government when it came to power.

The Goss cabinet ordered the shredding of all the documents collected by
Heiner and this marked the beginning of the Heiner Affair.

Rudd was premier Wayne Goss's chief of staff at the time and subsequently
became the director-general of his cabinet office. It was widely held that
nothing took place within cabinet without his knowledge, and he has also
claimed his experience running Goss's cabinet has equipped him to be prime
minister of Australia.

Though both Rudd and Queensland Premier Peter Beattie claimed as recently as
last week that the shredding of the documents needed no further investigation, it
has never been fully examined.

Both Rudd and Beattie also rejected the view of former chief justice of the High
Court Sir Harry Gibbs and an unprecedented plea from a former West
Australian chief justice (David Malcolm), two retired New South Wales chief
judges (Jack Lee, now deceased, and Dr Frank McGrath), two retired New
South Wales Supreme Court justices (Roddy Meagher and Barry O'Keefe), one
of Australia's foremost QCs (Alec Shand) and a legal academic and barrister
(Alastair MacAdam) that an independent special prosecutor be appointed to
examine the matter.

The most thorough inquiry to date was conducted by a House of
Representatives committee chaired by federal MP Bronwyn Bishop, which
recommended that 'members of the Queensland cabinet at the time that the
decision was made to shred the documents gathered by the Heiner inquiry be
charged for an offence pursuant to Section 129 of the Queensland Criminal
Code Act 1899. Charges pursuant to sections 132 and 140 of the Queensland
Criminal Code Act 1899 may also arise'.

Further, a recent two-year audit of the matter by prominent Sydney QC David
Rofe, which ran to 3 000 pages contained in nine volumes, concluded there
were 67 unaddressed alleged prima facie criminal charges against the cabinet
and civil servants that needed to be urgently addressed.

Alice still suffers profound psychological problems, exacerbated by repeated
charges that she is a liar, but filed a complaint with the Queensland Police
Service in March 2006, following the release under Freedom of Information
legislation, which included evidence that the rapists had confessed to both a
staffer at the youth centre, and the director of the facility, Peter Coyne.

The documents show that not only was she raped, she was also denied her legal
rights by the Queensland police - and those entrusted with her care.

Alice has been interviewed by members of the Queensland police taskforce
Argos and a senior detective from Argos last Tuesday sought an interview with
another person who has maintained an interest in the matter.

Rudd, who describes himself as a 'compassionate Christian' has not sought any
inquiry into the attacks on the girl and has not offered any explanation of the
destruction of the documents, though he had the responsibility for the business
of the cabinet. Whether the Queensland police are now up to fully investigating
such a highly charged political matter, given their studious attempts to ignore it,
is questionable.

As a number of the nation's most senior legal figures have pointed out, there is a
strong precedent for bringing charges against those who ordered and participated in
the shredding of the Heiner material, as shown by the case brought against a
Baptist pastor Douglas Ensbey.

Ensbey suspected that a member of a family in his congregation was being
abused and, while dealing with the mother, was given pages of notes written by
the victim. The family said they would deal with the issue and asked for the
pages back, but Ensbey had guillotined them, making them difficult to read.

The victim went to the police, aged 20, and the assailant immediately confessed.

The police, however, concentrated on the sliced pages and charged Ensbey with
the destruction of evidence under S129. He was found guilty by a jury in March
2004, convicted and sentenced to two year's jail (reduced on appeal to six
months, wholly suspended).

The action of the Goss cabinet falls under the same section of the law the police
used to pursue Douglas Ensbey.

Many see parallels in the campaign by crusaders against child abuse to hound
former governor-general Peter Hollingworth from office, though it was never
alleged he was involved in a crime.

Former Opposition leader Simon Crean said: 'You cannot have people in
authority who have covered up for child sex abuse. It is as simple as that'.
And it is. But what can be said about an Opposition Leader who may have been

QUENTIN Bryce should be reminded
there’s room in this country for just one prime minister.

And she isn’t it.


Indeed, no-one ever voted to make Bryce our Governor-General,
other than the Prime Minister himself.

Yet her new job seems to have gone to her head, because our
Activist-General’s apparent pretentions to be the political leader we
neither asked for nor should want have become alarming.

Last month, for instance, Bryce called in the head of the defence
forces, Air Chief Marshal Angus Houston, the head of the Department of
Foreign Affairs, Michael L’Estrange, and the Treasury Secretary, Dr Ken
Henry, for official briefings.

This was a first for any governor-general, her spokesman confirmed to The Australian. (Correction:
the Governor General’s office has since informed us that this report
was false. Previous governors general have also received briefings.)

And I’m not surprised: does this former sex discrimination commissioner
think her titular role as Commander-in-Chief of the Armed Forces
actually gives her real power over our soldiers, sailors and airmen? In
January, Bryce forgot herself even more completely, going to a big
international conference in Dubai on renewable energy and calling on the
world to fight global warming.

“We must act swiftly, act smartly and act together,” she declared.
“Australia will play its full part in the global effort to make sure we
seize that opportunity.”

Er, we will?

Even our real Prime Minister is now rethinking that plan, shaken by the
recession, while the Opposition clearly wants Australia to wait a while
before doing anything that will cost jobs.

So who was Bryce speaking for? Herself?

No can do, lady.

Bryce actually knew perfectly well when she accepted the role of
Governor-General that playing politics like this was not part of the job
description.

Her job now is to represent all Australians, not just Greens voters, and
to stay well clear of the politics that would make her a polarising
figure.

It’s as the late Richard McGarvie, the much-admired governor of
Victoria, judge and Labor man said—the job must go to a “respected
person who remains entirely above partisan politics and exerts a
unifying influence”.

There is a critical reason for that, beyond the fact that political
meddling by an unelected governor is undemocratic, which is why we’d be
upset if even the Queen tried what Bryce is now flaunting.

Even more important is that the essential role of a governor is to make sure the constitution works as it should.

Usually that’s an uncontroversial task—signing into laws the Bills
passed by parliament, swearing in an elected government and dissolving
parliament when the prime minister asks.

But as we saw with the sacking of the Whitlam government in 1975,
sometimes a governor-general must act in ways that can—if not done
carefully by an apolitical figure—have us at each other’s throats,
screaming that democracy is dead.

Bryce knows all this, but an enforced silence clearly chokes a woman
whose career was spent almost entirely on wagging an improving
finger—whether for the National Women’s Advisory Council, the Human
Rights and Equal Opportunity Commission or the Sex Discrimination
Commission.

So while she promised to stop politicking, she couldn’t help adding:
“But that doesn’t mean you can’t express views and opinions on matters
of importance to the community.”

Or of importance to Bryce, to be exact. And off the Activist-General
then hared, leaping on political issues with barely a blush of shame.

She backed calls for paid maternity leave, just as the Rudd Government
decided to put this $450 million extravagance on the back burner.

She regally toured the Murray-Darling basin and demanded more leadership
in tackling the drought and global warming, both issues of fierce
political debate—not just between Labor and Liberal, but the Federal
Government and the states.

And she launched the book version of the Garnaut Climate Change Review,
spruiking a highly tendentious tome written by Rudd’s hand-picked
adviser on global warming to fulfil a Labor election promise.

It’s hard to think of a more political document for the Governor-General
to endorse, other than the Labor Party platform itself.

I do not doubt that Bryce means well, and has seized on the
Governor-General’s job to do it. But what she wants to do comes at a
cost to the role she’s been given, and is best done by an elected and
accountable politician.

May I suggest she stand for election?

But perhaps that is now too humble an option for the rather grand Bryce,
who set a new first last month by recording a televised address to the
nation.

Again, she meant well, saying comforting things to the victims of the Black Saturday fires.

But it was incongruous to see a woman few Australians would recognise
and none have chosen deliver a message in a form previously reserved for
a Prime Minister or Queen.

Rather above her station, I thought. And perhaps the next time the
cameras come calling to Yarralumla, Bryce might consider that rather
than get on the box, she should get back in it.

a "compendium of evidence" on the matter prepared by Sydney barrister David Rofe QC.

"adversely named" in Mr Rofe's document, a parliamentary committee was told.

As Her Majesty's shadow attorney-general for the State of Tasmania,
I wish to raise a matter of injustice which has concerned me greatly,
and I will be, with the consent of the minister, tabling in the House and
making available to Hansard, the full article written by Australia's leading writer,
Piers Akerman, and published nationally under the headline 'Tragic tale needs ending'.
It relates to what has become known as the 'Heiner affair'.

It arises in Queensland but it is a matter of concern to all in Australia who
are committed to the pursuit of justice. The article speaks for itself, but I am grateful to
the minister for allowing me to table it because it will save me reading it into Hansard.

Piers Akerman puts a very strong case for a proper judicial inquiry
into a shocking injustice, an injustice which has been covered up for 19 years.
It was raised at the Standing Committee of Shadow Attorneys-General meeting
in Sydney on Friday, which I attended;
it was chaired by the Commonwealth Attorney-General, the Honourable Philip Ruddock MP.

It was further raised at the national conference of Australians for a Constitutional Monarchy, which I addressed in Sydney the following day.

I seek leave to table the article by Piers Akerman and have it incorporated into Hansard.
I commend it to all members. If you accept, as I do, that the case here is overwhelming,
then the matter will be listed for proper debate in this Parliament at a later time.
Justice delayed is justice denied. The girl who suffered this massive injustice needs to

'Tragic tale needs ending
Federal Opposition leader Kevin Rudd may be called to answer questions
relating to the destruction of evidence as a police investigation into the rape of
Queensland girl 19 years ago gains new momentum.

The girl, who we will call Alice, was just 14 at the time and resident at the
John Oxley Youth Detention Centre, in the care of the Queensland Government,
when she was gang raped by other inmates.

Though some of the rapists confessed, no charges were pressed and the police
inquiry at the time was at best belated and perfunctory.

Alice's tragic story is but one strand of this horror,
the other is the Goss ALP government's attempt to
ignore her plight and bury the incident without trace.
That attempt began when an investigation directed by former magistrate Noel Heiner
and launched by the Cooper National Party government was shut down by the Goss government when it came to power.

The Goss cabinet ordered the shredding of all the documents collected by
Heiner and this marked the beginning of the Heiner Affair.

Rudd was premier Wayne Goss's chief of staff at the time and subsequently
became the director-general of his cabinet office. It was widely held that
nothing took place within cabinet without his knowledge, and he has also
claimed his experience running Goss's cabinet has equipped him to be prime
minister of Australia.

Though both Rudd and Queensland Premier Peter Beattie claimed as recently as
last week that the shredding of the documents needed no further investigation, it
has never been fully examined.

Both Rudd and Beattie also rejected the view of former chief justice of the High
Court Sir Harry Gibbs and an unprecedented plea from a former West
Australian chief justice (David Malcolm), two retired New South Wales chief
judges (Jack Lee, now deceased, and Dr Frank McGrath), two retired New
South Wales Supreme Court justices (Roddy Meagher and Barry O'Keefe), one
of Australia's foremost QCs (Alec Shand) and a legal academic and barrister
(Alastair MacAdam) that an independent special prosecutor be appointed to
examine the matter.

The most thorough inquiry to date was conducted by a House of
Representatives committee chaired by federal MP Bronwyn Bishop, which
recommended that 'members of the Queensland cabinet at the time that the
decision was made to shred the documents gathered by the Heiner inquiry be
charged for an offence pursuant to Section 129 of the Queensland Criminal
Code Act 1899. Charges pursuant to sections 132 and 140 of the Queensland
Criminal Code Act 1899 may also arise'.

Further, a recent two-year audit of the matter by prominent Sydney QC David
Rofe, which ran to 3 000 pages contained in nine volumes, concluded there
were 67 unaddressed alleged prima facie criminal charges against the cabinet
and civil servants that needed to be urgently addressed.

Alice still suffers profound psychological problems, exacerbated by repeated
charges that she is a liar, but filed a complaint with the Queensland Police
Service in March 2006, following the release under Freedom of Information
legislation, which included evidence that the rapists had confessed to both a
staffer at the youth centre, and the director of the facility, Peter Coyne.

The documents show that not only was she raped, she was also denied her legal
rights by the Queensland police - and those entrusted with her care.

Alice has been interviewed by members of the Queensland police taskforce
Argos and a senior detective from Argos last Tuesday sought an interview with
another person who has maintained an interest in the matter.

Rudd, who describes himself as a 'compassionate Christian' has not sought any
inquiry into the attacks on the girl and has not offered any explanation of the
destruction of the documents, though he had the responsibility for the business
of the cabinet. Whether the Queensland police are now up to fully investigating
such a highly charged political matter, given their studious attempts to ignore it,
is questionable.

As a number of the nation's most senior legal figures have pointed out, there is a
strong precedent for bringing charges against those who ordered and participated in
the shredding of the Heiner material, as shown by the case brought against a
Baptist pastor Douglas Ensbey.

Ensbey suspected that a member of a family in his congregation was being
abused and, while dealing with the mother, was given pages of notes written by
the victim. The family said they would deal with the issue and asked for the
pages back, but Ensbey had guillotined them, making them difficult to read.

The victim went to the police, aged 20, and the assailant immediately confessed.

The police, however, concentrated on the sliced pages and charged Ensbey with
the destruction of evidence under S129. He was found guilty by a jury in March
2004, convicted and sentenced to two year's jail (reduced on appeal to six
months, wholly suspended).

The action of the Goss cabinet falls under the same section of the law the police
used to pursue Douglas Ensbey.

Many see parallels in the campaign by crusaders against child abuse to hound
former governor-general Peter Hollingworth from office, though it was never
alleged he was involved in a crime.

Former Opposition leader Simon Crean said: 'You cannot have people in
authority who have covered up for child sex abuse. It is as simple as that'.
And it is. But what can be said about an Opposition Leader who may have been
complicit in the illegal shredding of evidence? If the ALP stands by the
standards it applied to Hollingworth, Rudd should resign and answer the
questions that the Queensland ALP has worked hard to avoid for 19 years.
