MAN bans are spreading as two more council functions are declared
off-limits because it is "not appropriate" for men to mix with Muslim
women.
And in a surprise twist, VCAT backed the latest bans,
declaring there was no discrimination
and councils no longer needed to apply for exemptions.
The Darebin City Council ban will be in force for a music concert to be held in December, while another female-only event to mark the end of Ramadan was cancelled last week.

But Ratepayers Victoria president Jack Davis said the bans were
"another case of segregation".
"I think it is totally wrong. I think it's ridiculous and I do think it is
discrimination, and it goes against what the average ratepayer wants,"
Mr Davis said.

Moreland council recently banned men from a dance event while Monash council
put up curtains at a public pool so Muslim women could have privacy during a
female-only exercise classes.
Darebin Mayor Diana Asmar said the latest bans involved events
promoted to young women who,
"due to their cultural and religious backgrounds,
cannot attend events where men and women both attend".
"The December event is a 10-week workshop series
that teaches young women DJ-ing skills.
The program culminates in a social event
that the young women plan and run themselves," she said.
"Darebin's approach is to always identify barriers
to community participation and address them."
Darebin council, with the support of the
Victorian Equal Opportunity and Human Rights Commission,
originally asked VCAT for an exemption under the
Equal Opportunities act so it could have women-only events.
VCAT ruled the events would not discriminate against anybody
and special exemption was not needed.
An Equal Opportunity spokeswoman said the decision meant
"organisations do not have to go through a formal VCAT hearing
to put in place practices (BANS) to assist groups to achieve substantive equality".
A spokesman for the Islamic Council of Victoria, Nazeem Hussain, said
the Darebin decision was not "controversial or surprising in the slightest".

Finland arrests two terror suspects

POLICE in Finland say they've arrested two people
suspected of financing terrorist activities and recruitment.
"Police have begun an inquiry into a suspected case of financing and recruiting
for a terrorist activity," the National Bureau of Investigation said a statement
overnight on the arrests carried out last week.
"On September 7, two people were arrested at the start of the preliminary investigation,"
it said.
Police added the two were still in custody and that searches had been carried
out at several homes and locations in the capital Helsinki.
The searches and arrests came after a long period of surveillance by the intelligence services.
In January, Finnish intelligence said it was keeping an eye on
"several dozen" inhabitants of the Nordic country
with contacts with the radical Shebab Islamist group in Somalia.

Supo spokeswoman Liinu Lehto-Seljavaara told AFP at the time.
"We have said there are a few dozen contacts that we have identified."
Friday's statement gave no indication of the affiliations or origins of the
suspects arrested less than a week after police in neighbouring Sweden
arrested four people with reported links to the Shebab on suspicion of
planning an attack in the city of Gothenburg.
A count of terrorism against the four has since been withdrawn,
but they still face charges for planning murder.

THE assumed right of unfettered freedom of speech was trumped by
laws protecting against racial vilification this morning after the
Federal Court delivered its decision on the controversial "white
Aborigines" case of Pat Eatock v Herald Sun columnist Andrew Bolt.
Justice Mordy Bromberg found Bolt and the Herald and Weekly Times
contravened the Racial Discrimination Act by publishing two articles on
racial identity which contained "errors in fact, distortions of the
truth and inflammatory and provocative language".
Speaking outside court, Bolt said it was "a terrible day for free speech in this country".
"It is particularly a restriction on the freedom of all Australians to
discusss multiculturalism and how people identify themselves," Bolt
said.
"I argued then and I argue now that we should not insist on the differences between us
but focus instead on what unites us as human beings," Bolt said.
Eatock v Bolt full Federal Court judgment
The columnist said he would read and consider the full judgment before commenting further.
Justice Bromberg said it was important to note his judgment did not forbid
debate or articles on racial identity issues if done "reasonably and in
good faith in the making or publishing of a fair comment".
"Nothing in the orders I make should suggest that it is unlawful for a
publication to deal with racial identification, including by challenging
the genuineness of the identification of a group of people," Justice
Bromberg said.
Ms Eatock and a group of eight other Aboriginals took Bolt and
the Herald and Weekly Times to court claiming racial vilifiication
over two articles in which he criticised fair-skinned Aborigines
for what he argued was a choice they made, as people of mixed
racial background, to emphasise their indigenous heritage over their
white heritage.
Ms Eatock welcomed the judgment, saying it was a statement against discrimination.
She said the court's decision meant racial identity could be debated, but with respect.
"It's how you handle it, you can't be malicious ... he (Bolt) must handle it based on truth and fact," she said outside court.
Ms Eatock told the Herald Sun she was aware of her Scottish ancestry
from her mother's side but saw herself as Aboriginal.
In the articles, on April 15 and August 21, 2009, Bolt wrote that some
fair-skinned Aboriginal people, whom he called "political Aborigines'',
had received prominence or indigenous awards because they chose to
identify with their Aboriginality.
The Eatock action claimed
Bolt's articles - which appeared under the headlines "It's so hip to be
black'' and "White fellas in the black'' - had "offended, insulted,
humiliated or intimidated'' them and were a breach of racial vilification laws.
In court during hearings in April, Neil Young, QC, for Bolt, had argued that
freedom of speech "trumped" other rights and was a cornerstone of democracy.
"Everything that's said, even if it's expressed colourfully, is rationally related to
a thesis that's a matter of public interest,'' Mr Young had said.
He argued the legal test for racial vilification was how an informed person would
interpret the views expressed in Bolt's articles.
But Ron Merkel, QC, for the complainants, said there was no attempt by Ms Eatock
or other members of the group to shut down freedom of speech or debate about racial identitity issues.
Mr Merkel said Bolt was free to express his views on the subject but should not have
chosen to attack the nine individuals he named in his columns and blog.
In the sometimes heated court exchanges, Bolt took exception to Mr Merkel's
comparison of the debate and Bolt's views to Nazi race laws, the Holocaust and eugenics.
Bolt argued those who chose to identify with only one part of their background
over another were contributing to racism and came at the cost of less focus on
the important issues of education, housing, health and poverty.
The parties were asked by Justice Bromberg to meet and discuss what orders the court should make.
The nine Aborigines who took legal action against Mr Bolt were former ATSIC
member Geoff Clark, artist Bindi Cole, academic Larissa Behrendt,
author Anita Heiss, health worker Leeanne Enoch, native title expert
Graham Atkinson, academic Wayne Atkinson, lawyer Mark McMillan and
activist Pat Eatock.
Mr Bolt and several of the plaintiffs were in court for today's decision.

to escape an arranged marriage.
The teen, who cannot be identified, asked a court to place her on
the airport watch list to stop her parents whisking her to Lebanon and
forcing her to wed a young man she had met just once.
The court said such applications were becoming increasingly common.
Federal magistrate Joe Harman said he was satisfied there was a psychological risk
to the girl unless the court intervened.
"The young person's evidence makes very clear that she has expressed to her
parents that she does not want to go to Lebanon and does not want to marry
the person proposed," he said.
"She has indicated also in her evidence that she is fearful for her personal safety,
that she has concerns as to what will occur in relation to her mother's reaction
once she becomes aware of these proceedings."
Teen girl missing for two weeks
Mr Harman said while it might be suggested the young woman had
bucked the authority of her parents, she had displayed great bravery in
seeking legal help.
"It is not the right of any parent to cause their child to be married against their will,
whether in accordance with Australian law or otherwise," he said.
Mr Harman restrained the girl's parents from removing her from Australia and from harassing, threatening or intimidating her, or questioning her about the court
proceedings.
He ordered that they surrender her passport to the court.
He also ordered the girl be placed on the airport watch list and Australian Federal Police maintain an airport watch for her.
The orders were made just two weeks before the planned wedding in the Middle East in April.
Details of the case have been revealed in a judgment published only this week.
The girl told the NSW court her father was aware of the proposed marriage but generally opposed it.
Mr Harman said that if she were taken to Lebanon, she would return married.
If the wedding were to take place in Australia, a court order and parental consent
would be required because of the girl's age.

had banned a 14-year-old would-be bride from leaving Australia.

Geoff Clark ... the Government must pay his legal costs,
which are expected to run to hundreds of thousands of dollars.
A court ruled today that Aboriginal leader Geoff Clark was
wrongly removed from his job as head of the Aboriginal and Torres
Strait Islander Commission.
But the judges say the decision has little practical bearing as
ATSIC was abolished by the Federal Government last year.
The full court of the Federal Court today dismissed an appeal by
Indigenous Affairs Minister Amanda Vanstone over her sacking of Mr
Clark from the position of chairman of the national indigenous
body.
Chief Justice Michael Black and Justice Mark Weinberg found that
Senator Vanstone failed to properly consider whether Mr Clark's
misbehaviour as ATSIC chairman impacted on his fitness to hold
office.
Senator Vanstone suspended Mr Clark from office on January 22
last year for misbehaviour after he was convicted and fined $750
for obstructing police during a pub fracas in the western Victorian
town of Warrnambool in 2002.
The Federal Government has been ordered to pay Mr Clark's costs,
which are expected to be several hundred thousand dollars.

A court has found News Limited columnist Andrew Bolt
breached the Racial Discrimination Act.

THE assumed right of unfettered freedom of speech was trumped by
laws protecting against racial vilification this morning after the
Federal Court delivered its decision on the controversial "white
Aborigines" case of Pat Eatock v Herald Sun columnist Andrew Bolt.
Justice Mordy Bromberg found Bolt and the Herald and Weekly Times
contravened the Racial Discrimination Act by publishing two articles on
racial identity which contained "errors in fact, distortions of the
truth and inflammatory and provocative language".
Speaking outside court, Bolt said it was "a terrible day for free speech in this country".
"It is particularly a restriction on the freedom of all Australians to
discusss multiculturalism and how people identify themselves," Bolt
said.
"I argued then and I argue now that we should not insist on the differences between us
but focus instead on what unites us as human beings," Bolt said.
Eatock v Bolt full Federal Court judgment
The columnist said he would read and consider the full judgment before commenting further.
Justice Bromberg said it was important to note his judgment did not forbid
debate or articles on racial identity issues if done "reasonably and in
good faith in the making or publishing of a fair comment".
"Nothing in the orders I make should suggest that it is unlawful for a
publication to deal with racial identification, including by challenging
the genuineness of the identification of a group of people," Justice
Bromberg said.
Ms Eatock and a group of eight other Aboriginals took Bolt and
the Herald and Weekly Times to court claiming racial vilifiication
over two articles in which he criticised fair-skinned Aborigines
for what he argued was a choice they made, as people of mixed
racial background, to emphasise their indigenous heritage over their
white heritage.
Ms Eatock welcomed the judgment, saying it was a statement against discrimination.
She said the court's decision meant racial identity could be debated, but with respect.
"It's how you handle it, you can't be malicious ... he (Bolt) must handle it based on truth and fact," she said outside court.
Ms Eatock told the Herald Sun she was aware of her Scottish ancestry
from her mother's side but saw herself as Aboriginal.
In the articles, on April 15 and August 21, 2009, Bolt wrote that some
fair-skinned Aboriginal people, whom he called "political Aborigines'',
had received prominence or indigenous awards because they chose to
identify with their Aboriginality.
The Eatock action claimed
Bolt's articles - which appeared under the headlines "It's so hip to be
black'' and "White fellas in the black'' - had "offended, insulted,
humiliated or intimidated'' them and were a breach of racial vilification laws.
In court during hearings in April, Neil Young, QC, for Bolt, had argued that
freedom of speech "trumped" other rights and was a cornerstone of democracy.
"Everything that's said, even if it's expressed colourfully, is rationally related to
a thesis that's a matter of public interest,'' Mr Young had said.
He argued the legal test for racial vilification was how an informed person would
interpret the views expressed in Bolt's articles.
But Ron Merkel, QC, for the complainants, said there was no attempt by Ms Eatock
or other members of the group to shut down freedom of speech or debate about racial identitity issues.
Mr Merkel said Bolt was free to express his views on the subject but should not have
chosen to attack the nine individuals he named in his columns and blog.
In the sometimes heated court exchanges, Bolt took exception to Mr Merkel's
comparison of the debate and Bolt's views to Nazi race laws, the Holocaust and eugenics.
Bolt argued those who chose to identify with only one part of their background
over another were contributing to racism and came at the cost of less focus on
the important issues of education, housing, health and poverty.
The parties were asked by Justice Bromberg to meet and discuss what orders the court should make.
The nine Aborigines who took legal action against Mr Bolt were former ATSIC
member Geoff Clark, artist Bindi Cole, academic Larissa Behrendt,
author Anita Heiss, health worker Leeanne Enoch, native title expert
Graham Atkinson, academic Wayne Atkinson, lawyer Mark McMillan and
activist Pat Eatock.
Mr Bolt and several of the plaintiffs were in court for today's decision.

A court has found News Limited columnist Andrew Bolt
breached the Racial Discrimination Act.

THE assumed right of unfettered freedom of speech was trumped by
laws protecting against racial vilification this morning after the
Federal Court delivered its decision on the controversial "white
Aborigines" case of Pat Eatock v Herald Sun columnist Andrew Bolt.
Justice Mordy Bromberg found Bolt and the Herald and Weekly Times
contravened the Racial Discrimination Act by publishing two articles on
racial identity which contained "errors in fact, distortions of the
truth and inflammatory and provocative language".
Speaking outside court, Bolt said it was "a terrible day for free speech in this country".
"It is particularly a restriction on the freedom of all Australians to
discusss multiculturalism and how people identify themselves," Bolt
said.
"I argued then and I argue now that we should not insist on the differences between us
but focus instead on what unites us as human beings," Bolt said.
Eatock v Bolt full Federal Court judgment
The columnist said he would read and consider the full judgment before commenting further.
Justice Bromberg said it was important to note his judgment did not forbid
debate or articles on racial identity issues if done "reasonably and in
good faith in the making or publishing of a fair comment".
"Nothing in the orders I make should suggest that it is unlawful for a
publication to deal with racial identification, including by challenging
the genuineness of the identification of a group of people," Justice
Bromberg said.
Ms Eatock and a group of eight other Aboriginals took Bolt and
the Herald and Weekly Times to court claiming racial vilifiication
over two articles in which he criticised fair-skinned Aborigines
for what he argued was a choice they made, as people of mixed
racial background, to emphasise their indigenous heritage over their
white heritage.
Ms Eatock welcomed the judgment, saying it was a statement against discrimination.
She said the court's decision meant racial identity could be debated, but with respect.
"It's how you handle it, you can't be malicious ... he (Bolt) must handle it based on truth and fact," she said outside court.
Ms Eatock told the Herald Sun she was aware of her Scottish ancestry
from her mother's side but saw herself as Aboriginal.
In the articles, on April 15 and August 21, 2009, Bolt wrote that some
fair-skinned Aboriginal people, whom he called "political Aborigines'',
had received prominence or indigenous awards because they chose to
identify with their Aboriginality.
The Eatock action claimed
Bolt's articles - which appeared under the headlines "It's so hip to be
black'' and "White fellas in the black'' - had "offended, insulted,
humiliated or intimidated'' them and were a breach of racial vilification laws.
In court during hearings in April, Neil Young, QC, for Bolt, had argued that
freedom of speech "trumped" other rights and was a cornerstone of democracy.
"Everything that's said, even if it's expressed colourfully, is rationally related to
a thesis that's a matter of public interest,'' Mr Young had said.
He argued the legal test for racial vilification was how an informed person would
interpret the views expressed in Bolt's articles.
But Ron Merkel, QC, for the complainants, said there was no attempt by Ms Eatock
or other members of the group to shut down freedom of speech or debate about racial identitity issues.
Mr Merkel said Bolt was free to express his views on the subject but should not have
chosen to attack the nine individuals he named in his columns and blog.
In the sometimes heated court exchanges, Bolt took exception to Mr Merkel's
comparison of the debate and Bolt's views to Nazi race laws, the Holocaust and eugenics.
Bolt argued those who chose to identify with only one part of their background
over another were contributing to racism and came at the cost of less focus on
the important issues of education, housing, health and poverty.
The parties were asked by Justice Bromberg to meet and discuss what orders the court should make.
The nine Aborigines who took legal action against Mr Bolt were former ATSIC
member Geoff Clark, artist Bindi Cole, academic Larissa Behrendt,
author Anita Heiss, health worker Leeanne Enoch, native title expert
Graham Atkinson, academic Wayne Atkinson, lawyer Mark McMillan and
activist Pat Eatock.
Mr Bolt and several of the plaintiffs were in court for today's decision.

Married women in India face huge pressure to produce male heirs who are seen as
breadwinners, family leaders and carers for their parents.
Girls are often viewed as a burden in traditional families as they require hefty dowries

In the past few decades, successive governments have launched an array of

THE head of Amnesty International says western countries that
intervene in international conflict on human rights grounds need to
"shape up or shut up".
Amnesty secretary-general Salil Shetty said countries including
the US and Australia must clean up their own human rights records.
"If they're going to be lecturing people, they have to really shape up
domestically and in their foreign policy, and it's kind of, you know,
shape up or shut up," Mr Shetty told ABC's Lateline.
He said the United States' use of the death penalty and torture practices during the war on terror were "simply unacceptable".
"This is where the issue of double standards and hypocrisy really starts to show up," he said.
Mr Shetty criticised the federal government's failed Malaysia solution,
saying Australia "should know better", while he described the Northern
Territory intervention as "the other blight ... on this country's
otherwise decent human rights record".
"The fact of the matter is that if you look at the current
practices and policies in the Northern Territory, what it's doing
effectively is widening the gap, not closing the gap," he said.
Mr Shetty said the Australian government had to "raise the game
and meet their international obligations".
He said people in the Middle East, North Africa and many developing
countries looked at western interventions in countries such as Libya
"with a great deal of suspicion", because they ignored many other
troubled countries such as Yemen.
