NURSES at Victorian hospitals are gagged from speaking out against
violence perpetrated against them at work and fear management, an
inquiry has heard.


Dandenong Hospital emergency department nurse Leslie Graham said
she suffers either physical or verbal abuse at work about every second
day.
Ms Graham told a parliamentary inquiry into security at the
state's hospitals that, in addition to verbal aggression, she and her
colleagues get bitten, punched and slapped and have objects thrown at
them.
"We have people ... pull their IVs out and throw
blood-stained cannulas, sharps, any kind of weapon they can get their
hands on, chairs, at the nursing staff," she said yesterday.
"You just press your duress (alarm) and run away."
Ms
Graham said despite frequently being subjected to violence she had
never reported it to police because she thought it would cause issues
with management.

"If I had a serious issue against myself I would report that to
the police, but I know that a lot of people are afraid of the
management of different hospitals,"
she said.
"(A nurse who) got
strangled never reported it to the police, and we weren't allowed to
make any of the public aware of the violence that we ... come up
against because then we could end up in court."
Ms Graham said
the design of the new $25 million emergency ward at the hospital, which
is run by Southern Health, also contributed to violence against staff.
There were instances where staff were backed into corners and unmonitored corridors, she said.
"We
have just had a brand-new emergency department that has been designed
and built not by anyone who has ever worked in an emergency
department," Ms Graham said.
The inquiry, held by state
parliament's drugs and crime prevention committee, was ordered by
Police Minister Peter Ryan after criticism of the coalition's
pre-election promise to station armed guards at emergency wards.
Ms
Graham said armed guards would not help the situation at her hospital
and there needed to be more unarmed security staff instead of just one
guard working between 6pm and 3am.
Royal Children's Hospital
emergency department nurse Peter Sloman said although the hospital's
new facility was more secure, there were still design problems.
The hospital's director of emergency services Simon Young said he did not support the introduction of armed guards.
Australian
Nursing Federation (ANF) Victorian branch assistant secretary Paul
Gilbert said the $21 million the government had pledged for 120 armed
guards could fund an extra 235 full-time nurses in emergency
departments.
ANF Victoria occupational health and safety
coordinator Kathy Chrisfield said introducing armed guards into
emergency departments would simply create another hazard.

LEGISLATION to tackle workplace bullying across Australia should be
introduced following the adoption of Brodie's Law in Victoria, advocates
say.


The Victorian law was named for 19-year-old Brodie Panlock who took her own life in 2006 after being bullied as a waitress.
The
workplace bullying laws were passed in Victoria in June and Ms
Panlock’s parents, Damian and Rae, said at the time they wanted to see
federal laws to make the offence punishable by up to 10 years' jail in
any state.
Employment law firm Maurice Blackburn has today called on the federal government to introduce national laws.
Maurice
Blackburn employment lawyer Josh Bornstein said workplace bullying was
present in all professions but was not specifically addressed by any
federal law.
"Workplace bullying involves degrading, belittling,
humiliating and threatening behaviour; in some cases it spills over into
violence," Mr Bornstein said.

"It is devastating for victims and their families and has an immense economic impact."
Mr
Bornstein said the productivity commission had estimated bullying and
harassment cost the Australian economy between $6 billion and $36
billion each year.
Mrs Panlock said in June Brodie’s Law sent "a clear message that bullying is a cowardly act and won't be tolerated".
"We'd like this law to be across the board from state to state," she said.
"I just hope that no family ever has to go through this again."
A Facebook page has been set up to support the call for federal laws.

THE Health Services Union paid tens of thousands of dollars to
federal MP Craig Thomson last year in a settlement, despite allegations
he spent union funds on prostitutes.


The revelation means the embattled MP has now double dipped from
Labor and the unions - taking more than $150,000 from Labor for his
legal fees against Fairfax, and taking tens of thousands more from the
HSU in a settlement after the allegations.
Mr Thomson had been
suing the HSU for defamation and for an alleged $190,000 in entitlements
for leave he claimed he was owed, which the union withheld after the
credit card allegations came to light.
Mr Thomson is accused of
stealing from the unions, including spending thousands on his credit
card hiring prostitutes and withdrawing more than $100,000 in cash
advances from the card from 2002 to 2007.
The union referred the matter to Fair Work Australia in 2008, a year after Mr Thomson entered Parliament.

But last year the union settled on the suits Mr Thomson had taken
against the union, paying him tens of thousands of the $190,000 he
claimed, sources have confirmed.
NSW Labor spent more than $150,000 on Mr Thomson's legal fees when he dropped a defamation suit against Fairfax.
Senior
Labor sources have said they paid Mr Thomson's fees amid concern he
would go bankrupt, which would have seen him ineligible to remain in
Parliament, and could have brought down the Gillard Government.
Union
sources have raised concerns a Fair Work Australia investigation into
the alleged rorts within the union has taken two years.
They are
also concerned the inquiry has not interviewed several people on the
Health Services Union's national executive who may have information.
Mr
Thomson's pregnant wife, radio newsreader Zoe Arnold, has taken early
leave from her radio station Sea FM on the Central Coast amid the stress
of the scandal.

THE Thomson prostitution affair intensified yesterday as the major
parties traded blows over the scandal that threatened to derail the
Gillard Government.


Trade Minister Craig Emerson accused the Opposition of capitalising on sleaze for political points.
He
warned Opposition MPs to "back off" over the mounting scandal and
claimed Opposition Leader Tony Abbott was trying an "easy, sleazy path
to The Lodge".
Mr Abbott returned fire during an address to the
Liberal Party State Council in Hobart, asserting that calling the
Gillard Government the worst since Gough Whitlam's was "very unfair on
Gough Whitlam".
"Gough Whitlam would never have run away from
parliamentary scrutiny the way this Prime Minister has over the last
fortnight," Mr Abbott said.
He claimed that a dirty shovel placed
on the doorstep of the home of HSU secretary Kathy Jackson, who
referred former union chief Craig Thomson to police amid claims of
fraud, was the work of operatives within the ALP.

to the police," Mr Emerson said.

THE union boss who blew the whistle on Labor MP Craig Thomson has
been offered police protection after a menacing threat at her Melbourne
home.

Kathy Jackson, whose actions could bring down the Gillard
Government, last night vowed to take on the "scumbags" who left a
dirt-covered shovel on her doorstep.
"Give it your best shot," the Health Services Union national secretary said, in a defiant challenge to her unknown attackers.
The Courier-Mail can
also reveal that Mr Thomson's initial defence - that he was interstate
when his credit card was used to hire prostitutes - has been severely
challenged by court records.
In a formal defence against the
allegations - contained in a May 2009 letter to the HSU lawyers - the
Labor MP argued he could not have spent $2475 on a Sydney escort agency
on April 9, 2005, because "I was in Melbourne".

But court records show that he rang the escort agency on April 7/8
and also paid by credit card on those dates - before later reversing the
charges and paying on a different credit card.
Ms Jackson
referred allegations that Mr Thomson had spent $150,000-plus of union
funds on prostitutes and other personal items to the NSW Police on
Wednesday.
The union official has refused police protection and
said she wouldn't "lock herself away", also claiming she was targeted
because she was a woman in the male-dominated union world.
"Women
should not be subjected to this sort of conduct," she said. "I'm a big
girl and if they think that this is going to stop us, then they have
picked the wrong girl."
Mike Williamson, the HSU national
president who is reported to have initially opposed Ms Jackson in her
attempts to have the Thomson matter referred to police, said: "I think
it was an appalling incident and I hope the police catch whoever was
involved very quickly."
The sinister twist came as the Coalition
called on Prime Minister Julia Gillard to explain when she had first
learned of the allegations against Mr Thomson, whose resignation would
likely see the demise of the Government.
"She owes it to the
public to tell us what she knew, when she knew it and what she did about
it," Opposition Leader Tony Abbott said yesterday.
Former
Industrial Registrar Doug Williams last night repeated his assertion
that Ms Gillard's chief of staff, Ben Hubbard, had rung him in the early
months of 2009 to inquire about Craig Thomson.
"I clearly believe
that the first time I heard of Mr Thomson, in relation to any inquiries
I was making, was in the phone call I received from Mr Hubbard," Mr
Williams said.
It can also be revealed that the HSU national
executive admitted there was a serious problem with the former national
secretary's credit card as early as March 2008, when it imposed a limit
on Kathy Jackson's credit card of $10,000 and limited other employees to
$5000.
Leaked HSU minutes show that the union imposed a rule that
there were to be "no cash withdrawals" from HSU credit cards and that
receipts and tax invoices were to be kept for all credit card
expenditure.
The Prime Minister yesterday denied having any prior
knowledge of the allegations against Mr Thomson before they were made
public in April 2009.
She said such a phone call would have been
"unremarkable" and part of regular communication between Government
advisers and public servants.
The Government also tabled a Senate
document that said Mr Williams had rung Mr Hubbard on April 8, 2009 -
the day before the first article appeared.

THE union boss who blew the whistle on Labor MP Craig Thomson has
been offered police protection after a menacing threat at her Melbourne
home.

Kathy Jackson, whose actions could bring down the Gillard
Government, last night vowed to take on the "scumbags" who left a
dirt-covered shovel on her doorstep.
"Give it your best shot," the Health Services Union national secretary said, in a defiant challenge to her unknown attackers.
The Courier-Mail can
also reveal that Mr Thomson's initial defence - that he was interstate
when his credit card was used to hire prostitutes - has been severely
challenged by court records.
In a formal defence against the
allegations - contained in a May 2009 letter to the HSU lawyers - the
Labor MP argued he could not have spent $2475 on a Sydney escort agency
on April 9, 2005, because "I was in Melbourne".

But court records show that he rang the escort agency on April 7/8
and also paid by credit card on those dates - before later reversing the
charges and paying on a different credit card.
Ms Jackson
referred allegations that Mr Thomson had spent $150,000-plus of union
funds on prostitutes and other personal items to the NSW Police on
Wednesday.
The union official has refused police protection and
said she wouldn't "lock herself away", also claiming she was targeted
because she was a woman in the male-dominated union world.
"Women
should not be subjected to this sort of conduct," she said. "I'm a big
girl and if they think that this is going to stop us, then they have
picked the wrong girl."
Mike Williamson, the HSU national
president who is reported to have initially opposed Ms Jackson in her
attempts to have the Thomson matter referred to police, said: "I think
it was an appalling incident and I hope the police catch whoever was
involved very quickly."
The sinister twist came as the Coalition
called on Prime Minister Julia Gillard to explain when she had first
learned of the allegations against Mr Thomson, whose resignation would
likely see the demise of the Government.
"She owes it to the
public to tell us what she knew, when she knew it and what she did about
it," Opposition Leader Tony Abbott said yesterday.
Former
Industrial Registrar Doug Williams last night repeated his assertion
that Ms Gillard's chief of staff, Ben Hubbard, had rung him in the early
months of 2009 to inquire about Craig Thomson.
"I clearly believe
that the first time I heard of Mr Thomson, in relation to any inquiries
I was making, was in the phone call I received from Mr Hubbard," Mr
Williams said.
It can also be revealed that the HSU national
executive admitted there was a serious problem with the former national
secretary's credit card as early as March 2008, when it imposed a limit
on Kathy Jackson's credit card of $10,000 and limited other employees to
$5000.
Leaked HSU minutes show that the union imposed a rule that
there were to be "no cash withdrawals" from HSU credit cards and that
receipts and tax invoices were to be kept for all credit card
expenditure.
The Prime Minister yesterday denied having any prior
knowledge of the allegations against Mr Thomson before they were made
public in April 2009.
She said such a phone call would have been
"unremarkable" and part of regular communication between Government
advisers and public servants.
The Government also tabled a Senate
document that said Mr Williams had rung Mr Hubbard on April 8, 2009 -
the day before the first article appeared.

thrown into disarray by a High Court ruling
that found the policy was invalid.

UPDATE 5.45pm: THE Government admits a High Court ruling ending the
Malaysian asylum deal is "a blow", as the Opposition says it was the
latest in a series of bungles.

No asylum seekers will be sent to Malaysia for the foreseeable
future after the High Court put a stop to the Federal Government's
people swap deal.

The Opposition now says the Coalition's former policy of dealing with asylum seekers in Nauru is the Government's only option.
Immigration Minister Chris Bowen said he was proud of the policy despite significant "blow" of the legal loss.

"Let's make no bones about it - today's decision by the High Court is a
profoundly disappointing one. Disappointing for the government,
disappointing for me,'' Mr Bowen said.

"I
respect the High Court's decision, but it doesn't mean I walk away from
the fundamental points of the policy, which is one the Government can
continue to be proud of.''

Asked whether the Government would now consider Nauru for offshore
processing of asylum seekers, Mr Bowen said he would not rule anything
in or out and said Cabinet would now consider the ruling.

Mr Bowen said the High Court decision had ramifications for all offshore
processing of asylum seekers and it had commissioned fresh new legal
advice.

He cabinet would carefully and methodically consider its next move.

He defended the policy saying there have been many fewer arrivals by boat
since the Government announced its Malaysian arrangement.

"It means we currently have 2000 people less in immigration detention
facilities than we had just three months ago. We've had the people
smugglers in retreat,'' he said.

"Today's decision is a significant blow, but it does not undermine mine or the Government's
determination to break the people smugglers' business model.''

He conceded the number of asylum seekers heading here would rise following the High Court decision.

"I think you can expect people smugglers to be capitalising on this arrangement,'' he said.

Mr Bowen insisted the Government had been on solid legal footing on its
original advice, but said the High Court had applied a new test to "how
protections should be demonstrated''.

"Clearly that is something which had not been understood before,'' he said.

He could not comment on the fate of 330 detainees who had been on standby
to be flown to Malaysia if the court had upheld the policy.

Mr Bowen said the Government had told Malaysia of the decision, but said it
would not be pushing Malaysia to change any of its laws.

Coalition says its time for the Nauru solution again

The Opposition has long called on Labor to reopen the mothballed
processing centre on Nauru which was a key plank in the former Howard
government's so-called Pacific Solution, with even former Labor
powerbroker Graham Richardson saying they would need to consider the option.

"Policy failure is never anything you would welcome but what we have seen today
in the High Court is yet another recognition of yet another policy failure by
this incompetent government,'' Opposition Immigration spokesman Scott Morrison said.

"This is a government whose failed non-solution for East Timor has now been followed up by
their Malaysia non-solution, prior to that was their failed asylum freeze.''

He
said Mr Bowen's Malaysia deal failure was a bungle that went "together
with everything from pink bats, and school hall rip offs and the NBN and
border protection failures, a government that simply can't get anything
right''.

Former Labor powerbroker Graham Richardson said the Government
has taken a thumping in the High Court
and now had no alternative but to swallow its pride and opt for a Nauru solution for asylum seekers.

Mr Richardson said the decision
made the Government look like a joke
"because frankly at the moment it is''.


He said everyone would have told the Government there would be a legal
challenge and whoever provided the legal advice that it was safe should be sacked.


"This is a thumping in the High Court,'' Mr Richardson told Sky News.

"They didn't just go down. They got slaughtered.

"There's nothing else for the government to do but to look elsewhere, and where else can you look bar Nauru?''

Mr Richardson said if the Government did opt for Nauru it should
"announce it quickly in the next couple of days''.

High Court's decision leaves asylum deal in tatters

Chief Justice Robert French said the court ordered Mr Bowen and his
department be restrained from sending asylum seekers to Malaysia.

"The declaration made was made without power and is invalid," Justice French said.

In a written summary of its judgment today, the High Court said it found the asylum deal could not proceed.

"Today the High Court held invalid the Minister for Immigration and
Citizenship's declaration of Malaysia as a country to which asylum
seekers who entered Australia at Christmas Island can be taken for
processing of their asylum claims," it said.

"After
an expedited hearing before the Full Bench, the Court by majority made
permanent the injunctions that had been granted earlier and restrained
the Minister from taking to Malaysia two asylum seekers who arrived at
Christmas Island, as part of a larger group, less than four weeks ago.

"The Court also decided that an unaccompanied asylum seeker who is under 18
years of age may not lawfully be taken from Australia without the Minister's
written consent under the Immigration (Guardianship of Children) Act 1946 (Cth)."

The High Court heard the case after Victorian human rights lawyer David Manne sought
an injunction on behalf of asylum seekers who were to be deported to Malaysia.

Lawyers for the asylum seekers had argued that under the Migration Act,
Australia had to ensure countries met the same human rights obligations
that apply to asylum seekers processed here.

They argued that the Immigration Minister did not have the power to send asylum seekers
to a country that has no legal obligations to protect them.

They also argued that sending unaccompanied minors to Malaysia would breach
the minister's duty of care as their legal guardian to act in their best interests.

But
Commonwealth Solicitor-General Stephen Gageler had argued the
Government could lawfully declare Malaysia a safe third country even
though it had no domestic or international legal obligations to protect
asylum seekers.

The Government had wanted to send 800 asylum seekers to Malaysia in exchange for 4000 already processed refugees.

In killing off the Malaysian solution, the court found the Minister could
not have declared Malaysia as a country to which asylum seekers could be
taken for processing unless it met critical human rights standards.

The ruling came down in a 5-2 decision to uphold the current injunction on the Malaysia deal.

An international law expert, speaking outside the High Court today, said
while no further appeals were possible, the Government could still potentially make the scheme work.

Professor Donald Rothwell said the Government could change migration and immigration laws.

"It is always within the scope of Commonwealth powers to amend legislation in the Parliament," Prof Rothwell said.

Meantime 330 asylum seekers slated to leave Christmas Island for Malaysia will now stay at the detention centre.

Refugee advocate Ian Rintoul told Sky News today he was surprised by the decision.

"It's a welcome result, but it doesn't rule out further attempts to process refugees in third countries," he said.

A WOMAN assaulted by a drug-addicted burglar
has challenged him to buy her dinner
and explain the benefit of his "lenient" sentence.


Jan Hibberd described a minimum 22-month sentence given to violent offender
Tony Ferraiolo in the County Court yesterday as pathetic and disappointing.

Ms Hibberd, a psychologist, sent Ferraiolo a message:
"I challenge you to come and see me when you're out of jail and tell me what you're doing with your life.

"Take me out to dinner and explain to me the benefit of the lenient sentence imposed on you."

Ms Hibberd told the Herald Sun: "My immediate reaction (to the sentence) is crime pays. What a laugh."

Unfortunately Jan Hibberd seems to exhibit very little emotional understanding for a psychologist. Not defending the actions of the criminal, but he is being punished. Hibberd could lose some of her anger by seeking psychological counseling to either forgive her attacker or move on.

I doubt, but hope, the judiciary will notice the number who have voted that they, the judges, are out of touch with community expectations. Every day we see examples of the judiciary

Doesnt sound like much of a psychologist to me. if he comes around for dinner after hes released he will have spent 2 years in jail and she wants him to explain what hes been doing with his life and how a lenient sentence has helped him? And we all know what great institutions our correctional facilities are for rehabilitating people!!!This guy will serve 2 years so whats the difference if he does 4 or 6, he still gets out. People want governments to build more jails and lock more people up but I'd rather build more hospitals.

So let's do the sums and see exactly how much it pays.
Perhaps this duo earned $1000 from their escapade?
and got 22 months (about 660 days)
1000 / 2 = 500 / 660 = .75c per day.
at 75 cents a day then i would say that, unequivocally, crime does not pay.

Cop offered sex proposal, Ballarat court hears

A POLICE officer allegedly tried to kiss a female victim-of-crime
following her frightened call to 000 over a domestic dispute, a court
has heard.
The second complainant in the committal hearing of former
police prosecutor Shaun Perry gave evidence yesterday, where she also
alleged that in a separate incident a senior police officer had
propositioned her with sex in exchange for him to “look after” her
ex-partner, who was the man involved in the domestic dispute.

The officer wasn’t named in court.

Shaun
Perry, 42, fronted Ballarat Magistrates Court yesterday for the third
day running, where he stands charged with two counts of wilful
misconduct, and single counts of attempting to pervert the course of
justice and unlawful assault.


The
second complainant, a middle-aged woman from the Ballarat area, spent
more than an hour in the witness stand where she was cross-examined by
Perry’s defence.


She told the court she was forced to call 000 one night in November 2009
after a domestic dispute occurred at her house.


She
claimed that a male police officer came to her home at some stage the
following day after calling her from a nearby phone box.


She alleged that at one point the officer put his hands on her hips, and
later leant forward and she was “pretty sure” he was going to kiss her.


When her ex-partner came out from hiding, the officer ran away, she said.


The woman told the court she had also informed the officer about a separate
alleged incident at the Ballarat Police Station where a senior police officer had
said that if she provided sex, he would “look after” her ex-partner.


The woman’s ex-partner also gave evidence, saying he saw the complainant
and a male hugging on the day in question.


“But from what I saw she wasn’t up for it,” he said.


Three police officers have so far given evidence in a hearing which is set to run into
a fourth day, with the informant expected to take to the witness stand this morning.


On
Tuesday and Wednesday this week, a separate complainant gave evidence
alleging she had sex with Perry on numerous occasions in early 2009
while she was facing her own criminal charges.


She claimed that hours after Perry interviewed her at the police station —
on January 16, 2009, the day they were said to have first met —
he went to her house and about 10 minutes after arriving they had sex.


Magistrate Peter Couzens is presiding over the case.

A SECOND complainant has given evidence in the committal hearing of
former Ballarat police officer Shaun Perry.


The woman is the alleged victim in three of the four charges facing Perry,
including one count of wilful misconduct in which Perry is said to have
contacted her — a victim of crime — in an attempt to initiate a personal
relationship.


The woman briefly took to the witness stand late this morning in

A POLICE officer allegedly tried to kiss a female victim-of-crime
following her frightened call to 000 over a domestic dispute, a court
has heard.
The second complainant in the committal hearing of former
police prosecutor Shaun Perry gave evidence yesterday, where she also
alleged that in a separate incident a senior police officer had
propositioned her with sex in exchange for him to “look after” her
ex-partner, who was the man involved in the domestic dispute.

The officer wasn’t named in court.

Shaun
Perry, 42, fronted Ballarat Magistrates Court yesterday for the third
day running, where he stands charged with two counts of wilful
misconduct, and single counts of attempting to pervert the course of
justice and unlawful assault.


The
second complainant, a middle-aged woman from the Ballarat area, spent
more than an hour in the witness stand where she was cross-examined by
Perry’s defence.


She told the court she was forced to call 000 one night in November 2009
after a domestic dispute occurred at her house.


She
claimed that a male police officer came to her home at some stage the
following day after calling her from a nearby phone box.


She alleged that at one point the officer put his hands on her hips, and
later leant forward and she was “pretty sure” he was going to kiss her.


When her ex-partner came out from hiding, the officer ran away, she said.


The woman told the court she had also informed the officer about a separate
alleged incident at the Ballarat Police Station where a senior police officer had
said that if she provided sex, he would “look after” her ex-partner.


The woman’s ex-partner also gave evidence, saying he saw the complainant
and a male hugging on the day in question.


“But from what I saw she wasn’t up for it,” he said.


Three police officers have so far given evidence in a hearing which is set to run into
a fourth day, with the informant expected to take to the witness stand this morning.


On
Tuesday and Wednesday this week, a separate complainant gave evidence
alleging she had sex with Perry on numerous occasions in early 2009
while she was facing her own criminal charges.


She claimed that hours after Perry interviewed her at the police station —
on January 16, 2009, the day they were said to have first met —
he went to her house and about 10 minutes after arriving they had sex.

A SECOND complainant has given evidence in the committal hearing of

IT'S always a mistake to make heroes of villains, and chic out of sick, but it's never more so than now.

Never in my lifetime have we seemed more in danger of fracturing into tribes ethnic, religious and social.

Never have we more needed to have examples set and moral codes affirmed so people are inspired to join, not divide.

But still our intelligentsia plays as being transgressive, like children fooling with a loaded gun.

Some examples, from just this month.

The Craig Thomson affair, of course, is the most toxic. What destructive message does Labor send when it plays down the use of a union credit card to pay for prostitutes and rip off workers?

But also look at the salons of this country, where the privileged toy with what would destroy us.

As Australia lost another soldier, killed by the Taliban in Afghanistan,
the Queensland Premier's Literary Awards shortlisted the memoirs of
David Hicks, who trained with the Taliban.

The soldier wins an early grave. Hicks may win $15,000,

Be clear about Hicks. His book may gloss over his training with some of
the world's worst terrorists, including al-Qaida, but his letters home
at the time boast about his then friends.

So what did Bligh do, after learning that her prize could now go to Hicks?

She did ... nothing. "I think it's important that we not get in the way of that," she said, as if enunciating some moral principle, rather than amoral.

Such are the times. When Hicks in May was given the stage at the taxpayer-funded Sydney Writers' Festival to promote his book, he got a standing ovation.

When former prime minister John Howard went to the same taxpayer-funded festival to sell his own autobiography, he was booed and heckled as a "war criminal".

Another example.

Last October Howard was being interviewed on the ABC's Q&A program when a member of the audience flung his shoes at him, shouting "that is for the Iraqi dead".

This kind of attack threatens democracy.

Who wants to get involved in public debates if it means exposing themselves to this or worse?

Yet the ABC has now donated the sneakers for an auction to raise funds for the Red Cross, headed by former Labor minister Robert Tickner.

It's for a good cause, they cry. But would the ABC donate a protester's "ditch-the-witch" sign mocking Julia Gillard, and would the Red Cross proudly raffle it?

No, this is yet another endorsement of rudeness, even intimidation, and shame on those who trash our values.

A WOMAN assaulted by a drug-addicted burglar
has challenged him to buy her dinner
and explain the benefit of his "lenient" sentence.


Jan Hibberd described a minimum 22-month sentence given to violent offender
Tony Ferraiolo in the County Court yesterday as pathetic and disappointing.

Ms Hibberd, a psychologist, sent Ferraiolo a message:
"I challenge you to come and see me when you're out of jail and tell me what you're doing with your life.

"Take me out to dinner and explain to me the benefit of the lenient sentence imposed on you."

Ms Hibberd told the Herald Sun: "My immediate reaction (to the sentence) is crime pays. What a laugh."

We law abiding Victorians are not safe, and we cannot rely on lawful self defence to protect us either, if an offender dies whilst you are defending yourself in your own home on your own property, you will be charged with defensive homicide, and the government of Victoria will fund the prosecution and every other person who is involved with you the victim, but you the victim will lose your home and all that you have, as you have to fund your own defence, and then after all that you will still be left with a debt to legal aid Victoria.

Struggling ... people cling to the wreckage of their boat
after it smashed against the Christmas Island coast.

A DISTRESS call giving out the co-ordinates of a
stricken boat carrying 105 Hazaras seeking asylum, who are now presumed
to have drowned, was received by Australian Customs and Border
Protection officials but the agency has never publicly revealed the
details.

Advice that the vessel was in distress and its position
in seas between Indonesia and Australia on October 3, 2009, was passed
by the agency to the Australian Maritime Safety Authority, which called
in the Indonesian search and rescue agency to take over the search.

But the boat has never been found and those on board have
not been heard from since, despite the Home Affairs Minister, Brendan
O'Connor, having later said that ''subsequent credible information''
showed the boat's difficulties had been resolved.

Customs has never revealed whether the distress call came

from the stricken vessel or from another source. Shortly after the boat
disappeared, frantic Afghan community members in Australia made
inquiries with the Department of Immigration and Customs and Border
Protection, but were told nothing about the fate of the boat.

Questions in Parliament in May, which have only just been
answered, reveal it was not until a story about the missing boat was
published three months later, on January 18, 2010, that Customs and
Border Protection ''reviewed its information holdings'' and found the
data.

Within two days of the story appearing, Mr O'Connor had
been briefed. But still, the families were told nothing. The opposition
spokesman for justice, customs and border protection, Michael Keenan,
said ''these are grave allegations about a minister misleading about
what the government knew and when they knew it. A possible tragedy of
this magnitude demands the fullest possible account of events.

''I urge Minister O'Connor to use the Parliament this
week to provide that account and to clarify the discrepancies in the
comments the government have already made on this matter. If he doesn't
take up that opportunity then we will look at ways that the Parliament
can make the government account for everything it knows."

The boat is one of eight believed to have sunk between
Indonesia, Malaysia and Australia in the past 2½ years. The most recent
vanished on November 14 last year with 97 on board after leaving a port
near Jakarta. It is believed many more have gone missing and one may
have disappeared just before the SIEV 221 smashed into rocks on
Christmas Island last December, killing 50.

An Iranian woman who lost five relatives in the tragedy
will tell the West Australian Coroner's Court next week that when she
inquired about the approaching boat Christmas Island detention centre
staff asked which boat she was talking about - the one the Navy had
detected or another that had gone missing.

Information about the 105 missing Afghan Hazaras, a
Persian-speaking ethnic group who live mainly in the central region of
Afghanistan, only came to light after the opposition asked in Parliament
what the government knew about each of the missing eight boats.

The families of the missing Hazaras have long questioned
how the boat could have vanished without trace, with two governments
aware of its existence. They had no idea the government had such
specific information about its distress.

Afghan community spokesman Hassan Ghulam, has called on
the government to release details of the distress call, who made it and
any other information available.

Mr Ghulam said relatives last received calls from those
aboard the boat saying that they were in international waters between
Java and Australia.

''The last call we know about was one of the passengers
saying we can see the Australian forces coming towards us. We are going
to throw our mobiles overboard,'' he said.

Mr Ghulam said the government needed to answer many
questions, including whether it had any satellite or radar images of the
boat.

He also wanted to know whether the navy saw them, and if
so, why did they not rescue them. The families of the missing deserved
to know what happened, he said.

''We are not blaming the authorities. People know they
are risking their lives when they get on these boats,''
he said. ''If
they have drowned, then we can have a funeral and get on with things.''

JULIA Gillard's Cabinet is divided over refugees and has canvassed
the option of abandoning the Malaysian solution and a return to onshore
processing.

But the Prime Minister is expected to prevail at a special meeting
of Cabinet tomorrow and stare down rebels in the ALP and Greens leader
Bob Brown.


Caucus tensions are rising as former PM Kevin Rudd continues to build his profile.


Mr Rudd's supporters have warned Labor colleagues that voters will "wipe
us off the planet" unless there is a change in leadership before the
next election.


A small group of backers in the ALP caucus is
urging colleagues to consider a back-to-the-future leadership ticket
before the next election with Defence Minister Stephen Smith also being
touted.


"The only way we are going to come out of this is to get Kevin back," a Labor MP said.

The new laws follow the High Court's ruling that the Malaysian solution people-swap was unlawful.

Desperate to secure the support of Tony Abbott
for the reforms in Parliament, the Prime Minister will outline
a deal that will allow the Coalition to pursue Nauru as a future option
and reactivate Labor's preferred regional solution, including Malaysia.


Two senior ministers have told the Sunday Herald Sun that
the High Court ruling prompted Cabinet discussions over
whether the opportunity had arisen to dump offshore processing.


Immigration Minister Chris Bowen even outlined the option in Cabinet,
but then explained why it was not an acceptable or effective method of
protecting the nation's borders.


Nauru was dismissed as an option because people smugglers knew
most asylum seekers ended up in Australia anyway and it was no longer
a deterrent.


The Gillard Government released costings yesterday suggesting the
Coalition's plan to reopen Nauru would cost $1 billion over four years.


"We know Nauru is not effective," Mr Bowen said.

"It's also a very expensive option."


There is still no guarantee the Coalition will support the new laws, a
prospect Labor has warned could result in up to 7000 asylum seekers
a year trying toreach Australia.


Immigration spokesman Scott Morrison said he was not going to be lectured
by the Gillard Government about cost blowouts.


"The Coalition is willing to work with the Government if they wish to make
changes to the Act to put the issue of offshore processing beyond legal
doubt," he said. "But we've made no secret of our position on Malaysia."


According to senior ministers, long-standing concerns were
expressed in Cabinet over offshore processing.


The ALP platform clearly says
refugees should have their claims processed in Australia.


Sources said the discussions were respectful and part of a wide-ranging
conversation of all options, rather than a direct challenge to the PM's
authority.


Left faction convener Doug Cameron, who once complained
the ALP caucus had become political zombies too scared to speak their
minds,
said the Malaysian solution was no solution at all.


"We should stick to the party platform," he said.

"That's onshore processing. It's the humane thing to do."

Northern Territory Senator Trish Crossin said:
"I don't think we should compromise on human rights as a first resort."


WA Labor MP Melissa Parke said she would argue strongly
against offshore processing.


ALP sources also suggested some Labor MPs may abstain from any vote.

They would face expulsion from the party
if they crossed the floor to vote with the Greens.

Prime Minister Howard was in Washington on September 11,

the 50th anniversary of our security alliance.

While his address had to be postponed, his heartfelt words of support

of the United States-Australian partnership.


Australia's quick declaration that these attacks were an assault on the values
and freedoms shared by our two countries comforted us; your invocation of
Article IV of the ANZUS Treaty strengthened our resolve to prevail over this menace.

Americans were moved by the expressions of sympathy
from so many Australians citizens, and we shared your grief at the loss of 11 Australians in the September 11 attacks.

In the decade since the attacks, we have had no more steadfast partner

in our effort to defeat terrorists in Afghanistan, in Bali,

NSW Police today established a strike force
to investigate ''inappropriate practices''
in the Health Services Union.


The HSU has been central to allegations that former senior officials,
including Labor MP Craig Thomson, misused union credit cards.

Mr Thomson has denied breaking the law.

But police announced that Strike Force Carnarvon was created after senior
police received additional information from union members this morning.


The investigating officers include senior members of the
State Crime Command's Fraud and Cyber Crime Squad.


"The NSW Police Force has established a Strike Force to investigate
allegations of inappropriate practices within the Health Services Union,"
said a statement.


There was no mention of Mr Thomson
or any other former or past official of the HSU.

The police had previously declined to investigate claims involving
the Labor MP for Dobell, who has been accused of using a union credit
card to hire prostitutes.


Liberal justice spokesman George Brandis sent police a 120-page dossier,
but they were not swayed by it after an assessment.


But it seems this morning's information
from the HSU sparked immediate action.


Senator Brandis said he had written a second time to
Police Commissioner Andrew Scipione, following news reports last Friday
that Mr Thomson and another senior union official were linked to
further claims of credit card use.


He requested the report be assessed "and, if appropriate, direct his officers
to make an investigation of those new allegations".


"As I have said from the beginning, we will respectfully await the outcome
of the NSW Police Investigation," Senator Brandis said in a statement.


"The decision to take the matter a stage further is a welcome development.
"I also look forward with interest to the promised detailed statement of Mr Thomson."

and though I'm searching from Australia and

it's all that's offered, in the order it's offered,
that also, 'says' a lot, though as usual, I've
had to remove the code that makes the cached
likes, 'live', and some other code that 'insists on'
showing here, and makes what Google shows,
virtually illegible.

And yes, there is much more besides, 'said' in this strangely presented,

NSW Police today established a strike force
to investigate ''inappropriate practices''
in the Health Services Union.


The HSU has been central to allegations that former senior officials,
including Labor MP Craig Thomson, misused union credit cards.

Mr Thomson has denied breaking the law.

But police announced that
Strike Force Carnarvon
was created
after senior police received additional information
from union members this morning.


The investigating officers include senior members of the
State Crime Command's Fraud and Cyber Crime Squad.


"The NSW Police Force has established a Strike Force to investigate
allegations of inappropriate practices within the Health Services Union,"
said a statement.


There was no mention of Mr Thomson
or any other former or past official of the HSU.

The police had previously declined to investigate claims involving
the Labor MP for Dobell, who has been accused of using a union credit
card to hire prostitutes.


Liberal justice spokesman George Brandis sent police a 120-page dossier,
but they were not swayed by it after an assessment.


But it seems this morning's information
from the HSU sparked immediate action.


Senator Brandis said he had written a second time to
Police Commissioner Andrew Scipione, following news reports last Friday
that Mr Thomson and another senior union official were linked to
further claims of credit card use.


He requested the report be assessed "and, if appropriate, direct his officers
to make an investigation of those new allegations".


"As I have said from the beginning, we will respectfully await the outcome
of the NSW Police Investigation," Senator Brandis said in a statement.


"The decision to take the matter a stage further is a welcome development.
"I also look forward with interest to the promised detailed statement of Mr Thomson."

It is dangerous to openly reject the beliefs and practices

'Management', includes those In Charge of Admissions.

You know, those with The Power to Decide, who DOES
and who DOESN'T "qualify" for things like X-Rays of
Twice, Severely Battered Heads and Broken bones,
(let alone treatment of such crippling injuries), and who
Have The Power TO OPENLY STEAL FROM ONES HANDBAG,
THE ANTIBIOTICS PUT THERE BY THE TREATING DOCTOR,
AFTER HE PERSONALLY ADMINISTERED The First Dose
(usually the nurses job), BECAUSE HE KNEW "THEY"
(the 'Management' Nurse), WERE COUNTERMANDING
HIS, THE DOCTORS ORDERS.

In that case, another prescription for those antibiotics,
arrived in the mail, with no note, cover letter or mention
of the source, some days later, when the pleurisy CAUSED
by the damage of a 20 minute Gang Bashing, had almost
become pneumonia.

And that one Management Nurse, 'just happens' to be
friends with those who, twice, beat me into hospital...

"ESCAPED" from it's screw top specimen jar before it
reached the lab for a biopsy...so "I" still don't know
what it was. 'Interestingly' though, that I was bumped
to the "Urgent" list by my new doctor, simply on reading
my old files (on suspicion of the likelihood of cancer),
BUT, now have to wait another 3 YEARS for tests,
BECAUSE "THEY" "LOST" THAT POLYP.

Cop offered sex proposal, Ballarat court hears

A POLICE officer allegedly tried to kiss a female victim-of-crime
following her frightened call to 000 over a domestic dispute, a court
has heard.
The second complainant in the committal hearing of former
police prosecutor Shaun Perry gave evidence yesterday, where she also
alleged that in a separate incident a senior police officer had
propositioned her with sex in exchange for him to “look after” her
ex-partner, who was the man involved in the domestic dispute.

The officer wasn’t named in court.

Shaun Perry, 42, fronted Ballarat Magistrates Court yesterday for the third
day running, where he stands charged with two counts of wilful
misconduct, and single counts of attempting to pervert the course of
justice and unlawful assault.


The
second complainant, a middle-aged woman from the Ballarat area, spent
more than an hour in the witness stand where she was cross-examined by
Perry’s defence.


She told the court she was forced to call 000 one night in November 2009
after a domestic dispute occurred at her house.


She claimed that a male police officer came to her home at some stage the
following day after calling her from a nearby phone box.


She alleged that at one point the officer put his hands on her hips, and
later leant forward and she was “pretty sure” he was going to kiss her.


When her ex-partner came out from hiding, the officer ran away, she said.


The woman told the court she had also informed the officer about a separate
alleged incident at the Ballarat Police Station where a senior police officer had
said that if she provided sex, he would “look after” her ex-partner.


The woman’s ex-partner also gave evidence, saying he saw the complainant
and a male hugging on the day in question.


“But from what I saw she wasn’t up for it,” he said.


Three police officers have so far given evidence in a hearing which is set to run into
a fourth day, with the informant expected to take to the witness stand this morning.


On Tuesday and Wednesday this week, a separate complainant gave evidence
alleging she had sex with Perry on numerous occasions in early 2009
while she was facing her own criminal charges.


She claimed that hours after Perry interviewed her at the police station —
on January 16, 2009, the day they were said to have first met —
he went to her house and about 10 minutes after arriving they had sex.


Magistrate Peter Couzens is presiding over the case.

A SECOND complainant has given evidence in the committal hearing of

The woman is the alleged victim in three of the four charges facing Perry,
including one count of wilful misconduct in which Perry is said to have
contacted her — a victim of crime — in an attempt to initiate a personal
relationship.


The woman briefly took to the witness stand late this morning in
the Ballarat Magistrates Court, and will continue giving evidence this afternoon.


In total, 42-year-old Perry is charged with two counts of wilful misconduct
and single counts of attempting to pervert the course of justice and unlawful assault.


So far nine witnesses have given evidence, including three Ballarat police officers.


The first complainant who gave evidence on Tuesday and Wednesday this week
claimed that hours after Perry first interviewed her at the police station on the day
they were said to have met — January 16, 2009 — he went to her house and about
10 minutes after arriving they had sex.


The hearing before magistrate Peter Couzens is scheduled to finish this afternoon,
but could go into a fourth day if required.
