CHINA has become Australia's biggest source of migrants, for the first
time eclipsing the traditional main points of origin, New Zealand and
Britain.

The latest migration figures show a record 6350 settlers arrived from
mainland China in the four months to October, more than the 5800 who
arrived from Britain and the 4740 who came from New Zealand.

The new Chinese ascendancy owes more to a collapse in migration from the
traditional sources than it does to the 15 per cent annual growth in
migration from China. The number of migrants from Britain is down 28 per
cent over the year and the number from New Zealand is down 47 per cent.

An Adelaide University demographer, Graeme Hugo, said the global
financial crisis had hit migration from traditional sources in ways that
hadn't much affected China.

In March the Government sliced 18,500 off the skilled migration program
for 2009-10, disproportionately hitting Britain for which skilled
migrants account for eight out of 10 flights booked. Chinese migration,
dominated by family reunions, suffered less.

Professor Hugo said New Zealand migration collapsed as people decided to
hang on to their jobs. ''Just as someone from Adelaide is likely to try
to hang on to their job in the global financial crisis rather than move
to Sydney or Melbourne to take their chance at a time of tightening
employment, I think that would be the case in Auckland as well,'' he
said.

''It's an immediate response. New Zealanders don't need to apply to
immigrate. There's no pipeline - that's why the response is so big.''

Figures for short-term arrivals, also released yesterday, show a change
in where visitors are choosing to stay. NSW, traditionally the most
popular state, received 6 per cent fewer visitors over the past year.
Victoria and Western Australia received 9 and 15 per cent more visitors
respectively.

At the same time the high dollar and the continuing effect of bonus
payments sent a record 570,200 Australians overseas on holiday in
October, meaning that for at least some of the month one in every 40
Australians was out of the country.

Departures climbed 20 per cent in October, swamping a 7 per cent recovery in arrivals.

NZ remained the most popular destination with travel to Indonesia and
the US up 51 and 47 per cent on the previous year. Travel to Malaysia
jumped 50 per cent, travel to the Philippines 40 per cent, and travel to
Fiji 24 per cent.

The executive director of the Tourism and Transport Forum, Brett Gale,
said the boom came at a cost to the local tourist industry.

''Over the past year departures have outnumbered arrivals by almost 600,000,'' he said.

''On the one hand, it's hurting domestic tourism, but more optimistically, there's an opportunity because it has made so
many new airline seats
available to bring overseas

Retiring judge says
sentences too soft

It is not unusual to hear
criticism of judges and their sentencing
from politicians and public commentators,
but now a retiring Supreme Court judge
has backed that view.

In a parting shot, Justice Philip Cummins says
sentencing for sexual offences and violent crimes
too often falls short of community values.

Justice Cummins left the bench of the
Victorian Supreme Court in November,
so now he can say what he thinks of it.

He used his farewell speech
to attack the very system he served for 21 years.

"I consider the courts have not sufficiently secured
the rights of victims in doctrine, procedure and sentence,"
he said.

Justice Cummins told fellow judges their respect and concern
for the rights of victims is not reflected in outcomes.
He referred to provocation,
which was recently abolished as a defence to murder.

"It was not the common law or the courts that rid us of
the blight of provocation,
behind which much domestic and other violence
escaped true consequence," he said.

"It was public commentators and the media
and Parliament that did so.
Procedurally, it was not the common law
or the courts that sufficiently acted to preclude
the re-traumatisation of victims by court processes.
It was Parliament by procedural reform that did so."

Justice Cummins went further,
in a criticism of judges
which is usually the domain of
politicians and
[size=25]media commentators.

"With sexual offences, violence,
and especially domestic violence,
I think courts have fallen short on sentence," he said.

"Courts need to give significantly more attribution
to personal responsibility and to the consequences
of that responsibility.
I think that sentences imposed should better reflect
parliamentary provision and community values."

Former federal MP Phil Cleary
is an anti-violence campaigner.
He describes Justice Cummins's speech as
honourable and brave.

"Justice Cummins is speaking in code,
in a sense," he said.

"He's speaking to a group of judges.
He can't personally name them
and he can't point to all their sins
so he has given us a general interpretation.

"There's no question that he's suggesting that
it's been the interpretation of the law
that's been a problem and that means
judges have been a problem."

"Sea level readings indicate a tsunami was generated.
It may have been destructive along coasts near the earthquake
epicenter and could also be a threat to more distant coasts,"
the center said.

The quake magnitude reading is based on the open-ended
Moment Magnitude scale which is used by US seismologists
and measures the area of the fault that ruptured and
the total energy released.

The quake was felt in Argentina as well.

The survey had initially put the magnitude of the tremor at 8.5 but later adjusted it to 8.8.

In Australia, the BoM said tsunami waves could start affecting Norfolk and Lord Howe Islands after 8.30am tomorrow.

NSW could be hit after 8.45am tomorrow while Queensland would be hit about 8.15am.

The website said the next advice would be issued by 9.15pm today.

when a powerful earthquake struck,

The 7.0 magnitude quake was measured at a depth of 22km
and was centred 81km east-southeast of Naha, Okinawa,
the US Geological Survey said.

Japan's Meteorological Agency issued a tsunami warning
off Okinawa island, which was later lifted. The agency
separately warned against possible landslides in Okinawa,
where rain was forecast later in the day.

Small waves of around 10cm were recorded in southern areas
of Okinawa island, the agency said, adding that additional
minor surges of the sea level may still be seen near the island.

It was the biggest jolt felt in Okinawa since 1996,
when the agency set up an automatic seismic intensity gauge
in the sub-tropical island, widely known as home to US military bases.

Two people aged 66 and 74 were injured as they fell following the
earthquake, but neither was seriously hurt, local officials said.

Water pipelines were ruptured at more than 20 places,
while a tree fell over in central Okinawa.

Yasushi Ohama, an Okinawa prefectural government official,
told AFP on the phone:
“The earthquake woke me up with fear this morning.

“It was the biggest one I have ever experienced,
but fortunately we have not received serious damage

that most would have bailed out of, and only when I've put man's 'common
sense' advice above trusting God, do I stuff up on my own. But advising
faith, without being clear about the difference between God's Word and
what religions teach, is dangerous in itself - why I post all those
links to the Hebrew, root word meanings - The Only Writings I've found
NEVER to fail.
From 'very' Catholic to New Age gurus and most teaching between, I've
only ever found Science/what is in the real world, to be fully explained
in God's Word. Like the warning signs of this age, that's 'difficult to
bear', and so, all the more reason to keep in touch, daily, with God.

oops, ran out of room, see, big question!...There is the thing about,
"MAYBE" being hidden from woes to come, but even the faithful are not
promised NOT suffering the first death, and That's The Good News! The
first death need not be permanent, just a 'big sleep', for
those who DON'T DENY The Holy Spirit of Truth...interesting in itself,

AUSTRALIA has softened its traditionally staunch support for Israel in
the United Nations but denied it was linked to tensions over the
country's apparent use of forged Australian passports in an
assassination in Dubai.

At a vote in the UN General Assembly - where Australia has been one of
Israel's strongest supporters - the government abstained from a
resolution demanding that Israel and the Palestinians investigate
possible war crimes during the assault on Gaza that Israel began in
December 2008.

Three months ago, Australia voted against a similar resolution which
sought to endorse the Goldstone report - a UN-sponsored paper which
accused Israel and Hamas of war crimes.

The Foreign Affairs Minister, Stephen Smith, said yesterday that the
change was not related to the passport scandal and that Australia
abstained because the latest resolution did not specifically endorse the
Goldstone report.

''Our vote on the resolution was neither determined nor influenced by
recent events,'' he said. ''The Australian government always considers
UN resolutions on a case-by-case basis and on their merits. Australia
abstained on this resolution because, unlike previous resolutions, it
did not endorse the Goldstone report.''

Six other countries also changed their votes, including Germany, Italy
and the Netherlands. Some countries, such as Britain, France and New
Zealand, shifted from abstention to support. Others, such as the United
States and Canada, voted against both resolutions.

Britain, France and Germany have all recently expressed anger at Israel after their passports were caught up in the Dubai plot.

One Department of Foreign Affairs source told the Herald there was no
doubt the decision to abstain was intended as a sign to Israel not to
take Australian support for granted.

''A number of things made it easier for us to switch our vote,'' the source said.

''Firstly, the Americans helped the Palestinians to soften the wording
of this resolution compared to the last one. Secondly, a number of other
countries had indicated that they were toughening their own positions
on Goldstone. But there is no question that the debacle surrounding our
passports being used in Dubai helped to make up the government's mind to
abstain. The final decision was taken late on Friday, Australian time,
just a few hours before the vote.

''Our pattern in the past has been to vote with the US when it comes to Israel, to show as much support for Israel as possible.

''We were also aware that the UK's decision to vote in favour of the
resolution was influenced by the fact that so many of their citizens had
been caught up in the Dubai assassination.''

The opposition foreign affairs spokeswoman, Julie Bishop, yesterday
accused the government of downgrading its support for Israel as part of
its campaign to win a UN Security Council seat.

''I don't understand the government's change of heart,'' she told the Herald.

''The Coalition's position has been consistent. Having voted against the
Goldstone report, we would continue to vote against it … Since coming
to office the government has weakened Australia's long-held position of
supporting Israel at the UN.''

Mr Smith last week publicly summoned the Israeli ambassador, Yuval
Rotem, over the suspected use of three forged passports by Israeli spies
in the Dubai killing. Mr Smith warned that if Israel was behind the
forgeries ''Australia would not regard that as the act of a friend''.

Israel has refused to confirm or deny involvement in the assassination.
Its embassy in Canberra would not comment yesterday on the passport
scandal or on Australia's UN vote.

The Prime Minister, Kevin Rudd, who has described himself as a lifelong
supporter of Israel, indicated on Saturday he did not believe Israel's
public response to the incident was acceptable.

Mr Smith has been fiercely critical of the Goldstone report, saying it
was excessively focused on Israeli actions and paid insufficient
attention to Hamas's rocket attacks against Israel.

Privately, Israeli officials expressed little concern at the vote,
saying the new UN resolution simply expanded a plan for internal Israeli
investigations of the allegations raised by the Goldstone report.

Facebook admits errors

THE deaths of two Australian schoolchildren
were felt half a world away at
the Facebook headquarters
in California's Silicon Valley last week.

Staff reacted with shock and disbelief as they learned of
the defacement of tribute pages set up to honour
12-year-old Elliott Fletcher and
eight-year-old Trinity Bates.

But from the Australian side of the Pacific, the human reaction at the social networking site seemed muted.

The events of the past week exposed
a chasm between the huge footprint
of Facebook in Australia --
with more than 7 million users nationally --
and the bare-bones local presence
of about four ad sales staff.

With Paul Borrud, Facebook's regional vice-president of sales in
Australia, refusing interviews and initially only written responses
emanating from the California headquarters, Facebook stood accused of
being faceless in Australia.

Now global communications and policy director
Debbie Frost has stepped forward to try to change that.

Frost, who has an Australian mother and grew up in Hong Kong, sat down
with Media in the lobby of the Four Seasons hotel in downtown San
Francisco.

While Frost stands by Facebook's policies and procedures, with the
benefit of hindsight she acknowledges that the company's communication
could have been better.

"I think if we had been a little bit more out there with our human face,
expressing how we really felt more as people than in writing, maybe
that would have helped," she said. "It's really hard to know how to
respond in a situation like this because we've not really seen it before
and sometimes you just can't believe what's happening.

"It's like, really? People are what?

"Are people really doing that to a tribute page for a dead child? None
of us as a group of people wants to see the product that we built used
like that. It's awful."

At the time, Frost and the Palo Alto team thought they were being
responsive to questions from Australia by providing written comment. She
defends the fact that Borrud would not comment as the local head of
Facebook -- this became a hot issue in Australia last week, but Frost
says it reflects the reality of the company structure, with a small
sales team in Australia and policy teams based in Dublin and Palo Alto.
"We have different people with different expertise everywhere around the
world and we only have a handful of people in Australia," Frost says.
"Paul can absolutely bring the policy department's attention to things
in his country -- and he did."

At the nub of the issue is a philosophical question about the role of
user-generated content online. Is Facebook a publisher or a platform? If
Facebook is subject to the traditional rules of publishing, then it is
legally responsible for all the content that it hosts -- a commercially
untenable position for a company of just 1000 employees for 400 million
users globally.

If it's a platform, then it's a neutral public space and while the site
might keep order and respond to problems as they arise, the users are
responsible for what they say and do. So far the platform interpretation
has been the prevailing one -- but that could change with the whim of
lawmakers.

Last week in Italy, three Google executives were convicted of violating
the privacy of a boy with Down syndrome because a third party uploaded a
video of the boy being bullied to YouTube, the video hosting site owned
by Google. The company described it as an "astonishing" decision with
crucial implications for internet freedom and said it would appeal.

Google argued it took down the video as soon as it was made aware of it,
but reviewing all user-created content in advance would be a
commercially crippling task since 20 hours of video are uploaded to
YouTube every minute.

Meanwhile, the Rudd government
is considering the idea of an online ombudsman
to try to force websites
to remove offensive material more quickly,
though jurisdictional issues would make it
difficult for Australia to regulate a US-based site like Facebook
without co-operation from the company.
The location of Facebook's servers --
the computers that host the website --
is a secret, but the company says
that none of them are in Australia.

Not surprisingly, Facebook's position is that the website is a platform.
"We didn't build a site to be a publisher, we built it to be a
platform," Frost told Media. "We built it to give people tools to share
information with each other and I think the enormous success we've seen
is testament to the fact that human people do want to do that and the
vast, vast majority -- hundreds of millions of people -- are not
behaving the way these few people did in Australia, so it seems to be
going OK as a system."

Frost says anyone can report objectionable content and in most cases
Facebook will review it within hours, though it can take up to 48 hours.
If it is found to be in breach of Facebook's terms of use -- which
includes bans on pornographic material and threats or harassment -- then
it would be removed. Frost notes that hoaxes and bad taste do not
automatically breach terms of use, though she would not comment
specifically on individual cases.

"We think that our approach is a fairly good one because you can report
content, you can get it taken down, you can get it taken down in any
language, you can get it taken down as fast as we're able once it's
reported and goes through that system," Frost says.

"If I put up nude graffiti on the side of a church, how do you report
that, how do you get it taken down in a way that's good enough for you?
It takes time in real life and on the web and we think our system is
actually more responsive."

The debate has been clouded by widespread confusion about the mechanics
of the cyber-vandalism. Federal Communications Minister Stephen Conroy
has been quoted saying Facebook needs to explain what went wrong with
its site security. But in fact, there was no security breach -- the
people who defaced the Bates and Fletcher tribute sites had Facebook
accounts and the tribute groups or pages were left open for anyone to
join or comment.

The intense scrutiny has so far been trained on Facebook, but people who
set up tribute sites do not have to wait for the website to remove
objectionable material. When a person sets up either a group or fan page
on Facebook, they can set controls about who is allowed to join or post
content and what types of content -- such as comments, photographs or
videos -- are permitted. The person running the tribute page can also
delete any content they want without any need for a higher authority to
intercede.

Frost says in the case of one of the Fletcher tributes, the problem was
compounded by the fact the group founder quit and the page was left
without an administrator. In light of the events of the past week, Frost
is keen to better educate Facebook users about the tools that are
available to them and she says Facebook would be happy to work with
governments on this if asked to do so.

The role of law enforcement in dealing with the cyber-vandalism of the
tribute sites is unclear, since most of the offending content was vulgar
and hurtful but not necessarily illegal.

There are two notable exceptions -- first, there are accusations that
the obscene imagery included child pornography, a matter that is
currently under investigation by police. Second, there are concerns the
matter may be sub judice and lead to contempt of court because of pages
set up to vilify Bundaberg man Allyn John Slater, 19, who has been
charged with the murder of Bates.

In a worst-case scenario, content like this can lead to a criminal trial
being aborted if it is found that it made a fair trial impossible. Facebook says it has had stored all its data and will hand it over if there is a request from Queensland police or the Australian Federal Police. Frost says she remains hopeful that Facebook and sites like it can continue to operate as platforms rather than publishers.

She says: "If I phone you up and say really offensive things, does that mean the mobile phone operator is liable for that?"

ASIO's quietly launched online recruiting drive
is part of a broader campaign the agency said
was aimed at "both passive and active job-seekers".

"We are seeking candidates from a broad range of
backgrounds and social-networking sites
provide access to a wide audience who may not
otherwise consider ASIO as an employer,"
an ASIO spokeswoman said.

"We have used demographic filters on the site,
simply because these roles are based in
Sydney, Melbourne and Canberra."

The Facebook ad shows an ASIO logo accompanied
by the caption:

Cunard Line announced the Queen Mary 2 will visit five states and the
Northern Territory next year, making a world-first circumnavigation of
the country.
It will sail from Cape Town to Sydney via Fremantle and Adelaide and
stop at eight Australian ports, including Sydney, Fremantle, Adelaide
and the Whitsundays as well as maiden visits to Cairns (Yorkeys Knob),
Darwin, Melbourne and Brisbane.

Her circumnavigation will also include a call at Bali.

Australians will be able to choose from three circumnavigation options
starting in February: a 22-night voyage departing Sydney, a 20-night
voyage departing Fremantle and a 21-night voyage departing Adelaide.
Fremantle, Adelaide and Sydney will each enjoy two visits from the liner during her 28 days in Australian waters.
Carnival Australia chief executive Ann Sherry said the decision was a sign of confidence in the Australian cruise market.

"This one decision will generate at least $10 million for the Australian
economy as the local cruise industry remains on track to contribute
more than $3 billion and carry one million Australians annually by
2020,'' she said.
Cunard president and managing director Peter Shanks said he expected
strong demand for the voyage from Australian and international markets.
The Royal Circumnavigation will not go on sale until mid 2010 to allow
the final itinerary details to be finalised with the various port
authorities around the country, but the company will be taking
expressions of interest from this Friday.

The Queen Mary 2 is currently docked at Woolloomooloo in Sydney on her
third round-the-world voyage, before heading to Adelaide tomorrow.
Queen Mary 2 is one of the biggest ships on the planet.
Capable of carrying 2620 guests and more than 1,200 crew, it has 10 restaurants, five pools, the largest ballroom at sea, the largest library at sea and the world's first floating planetarium

NASA TO BOOST AUSTRALIAN BASES

NASA will build two new space tracking dishes worth about $100 million as part of its ongoing commitment to Australian bases.

The announcement of the facilities, to be built at the Canberra Deep
Space Communications Complex over the next six years, comes 50 years
after Australia first collaborated with NASA.

NASA's Dr Charles Elachi said the decision to continue to invest in Australia was simple.

"We felt that the friendly relationship between our two countries and
the scientific capability in Australia made it a no-brainer," he said.
"Australia is world-renowned in the field of radio astronomy. You have some of the best scientists and engineers in the world."
Dr Elachi says Australia will benefit from the partnership too.
"We have been developing techniques in the US to use satellites to
monitor where hot places are, so we can help citizens move away from the
[fire] hazard and tell firefighters where to go despite all the smoke,"
he said.
"By putting instruments on the space station which can see in infra-red and go through the cloud and smoke cover."

NASA technology mapping soil moisture on a large scale could also help farmers.

The five Australian sites shared between NASA and the CSIRO are used as
satellite communication bases during space missions and astronomy
research.

Highlights over the past 50 years have included the Mars rover and the Apollo moon missions.

Since the 1960s, the US government has invested $610 million in its
Australian facilities, giving jobs to Australian scientists and allowing
them to access cutting-edge expertise.
The latest Space Vehicle Tracking and Communications Facilities
agreement will stand for two years while a long-term strategic treaty is
developed.
Dr Charles Elachi says he is looking forward to another 50 years of partnership.
"Australia is an integral part of our space exploration," he said.

The fire, at the Buangor Ferntree waterfalls, has been described as a medium blaze, moving slowly south. It is creating spot fires up to 500m ahead of the main blaze. Chinese buyers underpin housing prices

ASIAN buyers are putting a fire under the country's housing markets,
with capital-city sales -- particularly to Chinese buyers -- doubling in
the past 12 months, according to a real estate group.


Chinese government restrictions phased in from last year to dampen
domestic real estate speculation had sent a wall of capital offshore,
said Brian White, chairman of Ray White.

At the top end of the Sydney market, a Chinese buyer was one of three
parties vying for a $30 million home, Mr White said. The others are an
American and an Australian.

Local Asian buyers had had a huge impact on the first-home buyer market
last year, but that had flowed though into the upgrade and prestige
markets, Mr White said.

"It is a new market force and one which we had underestimated the strength of," he said.

Sydney prestige homes, particularly over $4m, had
increased in price by 10 per cent, with offshore buyers helping to fuel

much of the Asian buying activity was in Melbourne, Mr White said.
The growing trend of mostly Asian parents buying apartments, many worth
more than $2m, for their children to live in while studying here was
also fuelling capital-city residential markets.

Ewan Morton, managing director of Sydney-based Morton and Morton, said
16 per cent of the real estate agency's sales last year were to Chinese
buyers, with $21m in property changing hands. This compared with 5 per
cent in 2008.

The trend had continued this year and buyers were interested in listings between $6m and $8m.
"I don't see it abating," he said."The mainland Chinese are looking for
purpose-built new apartments with water views . . . their kids are here
studying."

Colliers International's NSW director of project marketing, Murray Wood,
said that at the Stamford Residences, a 30-level tower at The Rocks in
Sydney, one buyer recently bought an apartment for $2m for their child
to live in while studying here. About six of 122 apartments had sold to
mainland China.

Agents say the student market has also boomed in Melbourne.
Colliers International's managing director of project marketing for
Victoria, Tim Storey, said about half of the 100,000 people living in
central Melbourne were overseas students.

Global real estate adviser DTZ's Queensland project marketing director,
Paul Barratt, said while less than 1 per cent of Queensland's
residential property was sold to foreign buyers, changes in late 2008 by
the Foreign Investment Review Board allowing 100 per cent of a new
residential project to be sold to offshore buyers, meant this could
change.

asking that common sense be applied to the issue.


Speaking on Eddie McGuire's Triple M radio show this morning, Mr Rudd
defended Australia's record immigration intake and his policy on asylum
seekers in the wake of stinging criticism by Federal Opposition Leader
Tony Abbott.

"Since the war, immigration in this country has been a bipartisan policy
and you run into people every day whose parents came out, who have come
out themselves and just contributed hugely to our country's future,''
he said.

"So I just think there's a bit of common sense to be applied in all of
this, and migration policy, since the war, has been bipartisan and I
think it should stay that way in the future.''

Mr Abbott said this morning that Christmas Island has become nothing
more than a waiting room for asylum seekers to gain permanent entry.
The government has reneged on its promise to maintain a hard line on
border protection by allowing asylum seekers to be processed in
Australia instead of offshore, Mr Abbott told ABC Radio.

"This was part of Mr Rudd's pre-election pitch and now, having promised
to be tough on border protection he's bringing people who haven't been
processed to the mainland,'' Mr Abbott said.

"What we can't have as a situation is people thinking that if they get here they can stay here.''

Mr Abbott has called for temporary protection visas to be brought back
to curtail people smugglers from targeting "desperate people''.
Strong ties between Australia and transit and source countries are also important, he said.

"We've got to be able to turn boats around,'' he said.

"A country which can't protect its borders is a country which is losing one of the essential attributes of sovereignty.''

Mr Abbott has declared he will do "whatever it takes" to stop illegal boat arrivals if he wins office.

Another 70 boats carrying asylum-seekers are tipped to arrive before the federal election, expected later this year.

The surge comes as failed asylum-seekers are being offered $1000 taxpayer-funded bribes and airfares to go home.

A group of 89 men who were transferred from Christmas Island to the
mainland on the weekend were offered the cash, on the condition they
drop any appeals.

As the boat people crisis deepens, the Coalition has again raised the
prospect of restoring John Howard's controversial Pacific Solution -
transferring asylum-seekers to detention camps on small islands.
That would make border protection a major election issue.

Mr Abbott told the Herald Sun he would bring back tough laws.
"John Howard stopped the flow and, given his success, there is no reason
why a future government that had sufficient resolve could not do the
same thing," the Opposition Leader said yesterday.
"We would do whatever it takes to ensure that effective deterrents are in place."
High-level government intelligence suggests there will be no let-up in
the surge of boats carrying asylum-seekers from Afghanistan, Sri Lanka,
Pakistan, and other countries, and senior government sources concede
this.
Thirty-two boats have arrived this year, carrying 1574 asylum-seekers.
Mr Abbott would not promise to restore the Pacific Solution, but his
immigration spokesman, Scott Morrison, suggested it could be high on a
Coalition government's agenda.

"The Coalition is not ruling any of that out," he said.

Under the Pacific Solution, asylum-seekers were transferred for
processing to Nauru and Manus Island, in addition to Christmas Island.

The policy was widely criticised by refugee advocates and the Rudd
Government scrapped the scheme when it came to office in 2007.

But the Coalition is determined to take a tougher approach on border
protection to the election, including a form of temporary visa - a
scheme also scrapped by Labor.

The surge in boat people has also seen at least 277 asylum-seekers
transferred to the mainland without visas under Kevin Rudd's watch.

They include the 89 men transferred to Sydney.

The Immigration Department said cash offers to leave were last used under the Pacific Solution, to clear Nauru.

Even though their refugee applications have been rejected, not all the
group are likely to end up being deported. Some stand a good chance of
winning permanent residency visas under a special humanitarian appeal
process - introduced by the Rudd Government.

"There has been a reasonable success rate at review level. There's a lot
of cases of people being accepted following merits review," said Ian
Rintoul, from the Refugee Action Coalition.

But an Immigration spokesman said three out of four boat people lost their appeals.

Of the 4386 unauthorised arrivals since the Rudd Government took power, just 146 have been returned home.

The Herald Sun can also reveal that 20 of the 24 detainees who
have escaped from detention centres since July last year remain on the
run. Most are Chinese.

Australia appoints first population minister

SYDNEY — Prime Minister Kevin Rudd on Saturday announced Australia's
first population minister, citing concerns about sustainability as the
number of people is tipped to balloon within decades.

Rudd, who has previously talked of a "Big Australia", said the
government needed to plan for an ageing and growing population which a
recent report forecast would jump from 22 million to 35.9 million within
40 years.

"Many Australians have legitimate concerns about the sustainability of
the population levels in different parts of the country," the prime
minister told reporters in Canberra.

"Particularly its impact on urban congestion, its impact on the adequacy
of infrastructure, its impact on the adequacy of housing supply, its
impact on government services, its impact also on water and agriculture.

"Our challenge is to make sure that we get our future population levels
as right as possible, and... make sure we're planning properly," Rudd
said.
Rudd said Agriculture, Fisheries and Forestry Minister Tony Burke would take on the additional portfolio.

The government has previously warned the economic threat of a booming
and ageing population is as grave as that posed by climate change, and
would drive up government spending and slow growth.

In October Treasury Secretary Ken Henry warned the rapid increase would "test the limits of sustainability".

"Our record has been poor, and in my view, we are not well placed to
deal effectively with the environmental challenges posed by a population
of 35 million," Henry said.

Government suspends processing of Sri Lankan, Afghan asylum claims

AUSTRALIA has suspended the processing of all immigration claims from Sri Lankan and Afghan asylum seekers.


"The decision has been made in the light of changing circumstances in
both Afghanistan and Sri Lanka," Immigration Minister Chris Evans said.

"The likelihood of people being refused visas and being returned safely to their homelands will increase."

The suspension is effective immediately.

The Government will review the situation in Sri Lanka after a period of
three months and in Afghanistan after a period of six months.

Senator Evans said the Government would continue processing claims from
those already on Christmas Island or on the way there, and that all
"irregular" maritime arrivals ...more at the link

Undersea volcano threatens southern Italy: report

ROME — Europe's largest undersea volcano could disintegrate and unleash a
tsunami that would engulf southern Italy "at any time", a prominent
vulcanologist warned in an interview published Monday.

The Marsili volcano, which is bursting with magma, has "fragile walls"
that could collapse, Enzo Boschi told the leading daily Corriere della
Sera.
"It could even happen tomorrow," said Boschi, president of the National Institute of Geophysics and Volcanology (INGV).

"Our latest research shows that the volcano is not structurally solid,
its walls are fragile, the magma chamber is of sizeable dimensions," he
said. "All that tells us that the volcano is active and could begin
erupting at any time."

The event would result in "a strong tsunami that could strike the coasts of Campania, Calabria and Sicily," Boschi said.
The undersea Marsili, 3,000 meters (9,800 feet) tall and located some
150 kilometres (90 miles) southwest of Naples, has not erupted since the
start of recorded history.

It is 70 kilometres long and 30 kilometres wide, and its crater is some 450 metres below the surface of the Tyrrhenian Sea.
"A rupture of the walls would let loose millions of cubic metres of
material capable of generating a very powerful wave," Boschi said.
"While the indications that have been collected are precise, it is impossible to make predictions. The risk is real but hard to evaluate."

Earthquake measuring 7.2 on the Richter scale rocks Los Angeles

UPDATE 10.20am: A SERIES of powerful aftershocks have been shaking Southern California following an earthquake in Mexico.


The US Geological Survey said three strong jolts including a 5.1
magnitude aftershock were felt in the Imperial County desert east of San
Diego, California, in the hour after a 7.2 magnitude quake struck in
Baja California, Mexico, southeast of Mexicali.

Magnitude-4.5 and magnitude-4.3 aftershocks came before and after.
The initial quake struck at 3:40pm on Sunday (8.40am Monday, Melbourne
time) at an area that has been hit by magnitude 3.0 quakes all week.
The earthquake rattled buildings on the west side of Los Angeles and in
the San Fernando Valley, interrupting Easter dinners. Chandeliers swayed
and wine jiggled in glasses.

Tremors were felt as far away as Phoenix, Arizona.
In Los Angeles, the city fire department went on earthquake status and some stalled elevators were reported.
No damage was reported in Los Angeles or San Diego.

In the Phoenix area, Jacqueline Land said her king-sized bed in her
second-floor apartment felt like a boat gently swaying on the ocean.

"I thought to myself, that cant be an earthquake, I'm in Arizona,'' the Northern California native said.

"And I thought, oh my God I feel like I'm 9 years old.''

A police dispatcher in Yuma, Arizona. said the quake was very strong
there, but no damage was reported. The Yuma County Sheriff's Office had
gotten a few calls, mostly from alarm companies because of alarms going
off.

Mike Wong, who works at a journalism school in downtown Phoenix, said he
was in his second-floor office getting some work done on Sunday
afternoon when he heard sounds and felt the building start to sway.

"I heard some cracking sounds, like Rice Crispies,'' he said.
"I didn't think much of it, but I kept hearing it, and then I started
feeling a shake. I thought, 'You know what? I think that might be an
earthquake.''

Mr Wong said the swaying lasted for "just a few seconds,'' and he didn't notice any damage.

Massive earthquake hits Northern Sumatra, Indonesia

UPDATE 11.16am: A POWERFUL earthquake hit Indonesia's Sumatra
island early today, causing widespread panic and tsunami warnings but no
major damage.

The quake struck off the northwest coast in an area devastated by the
massive Asian tsunami of 2004, triggering local warnings and an alert in
nearby Thailand.

The quake was initially measured at a magnitude of 7.8 but this was
later downgraded to 7.7 by the U.S. Geological Survey (USGS).
It struck at a depth of 31km, just off northern Sumatra, at 5:15am (local time).

AUSTRALIANS are taking advantage of the strong Aussie dollar and low
air fares to head overseas more as travellers bounce back from the
global financial crisis.


Latest overseas and arrivals data from the Australian Bureau of
Statistics shows 56 per cent more people travelled to Indonesia in
February compared with the same time last year, 33 per cent more to the
United States and 32 per cent more to Thailand.
The Australian dollar was hovering around 93 US cents.

Australia is commonly known as the oldest continent. Zircons dated
between 4,300 and 4,200 million years have been found in the Archean
rocks of the Mt Narryer area of Western Australia, and the microfossils
and stromatolites of the Pilbara, also in WA, are amongst the earliest
known life on Earth.

The old shield which forms a major part of the Australian continent is largely a flat and low-lying plateau, tectonically quiet and with one of the lowest erosion rates known. Deep weathering profiles dating to the Mesozoic and even earlier have survived, as have the corresponding ancient landscapes.

Ancient landforms
This contrasts with the northern hemisphere continents, where
late-Tertiary and Quaternary uplift and extensive glacial erosion have
given a very different landscape. Only in Tasmania and the higher parts
of the South Eastern Australia mainland can landscapes similar to those
of Europe be found.

The study of geological heritage in the former Gondwana continents, such
as Africa, South America, India and Australia, may need a different
approach to that used elsewhere.

Australia is an old continent, with extensive areas of little or no
outcrop, and with little exposure of the old and deep regolith below.
Landforms are often extremely old and their surfaces have changed little
in millions of years.

A broad area approach might be developed, perhaps using aspects of the
toposequence approach used by soil workers and land system mappers to
cover large areas with little outcrop or regolith exposure.

Whatever the way forward, there are some major problems that need
addressing. These encompass updating of records, funding, fair treatment
of Earth heritage, and the everyday practicalities of conserving the
best sites for educational and research purposes.

In terms of current data, state and national work on reports and files,
now often 20 years old, needs updating. This is particularly important
when planning issues arise; documentation must be able to withstand
close scrutiny.

On funding, because of a likely lack of national money in future, new
sources must be found to enable work to continue. Australian workers
must increasingly look to state or even local sources of support.

State registers
As the Australian government continues its current programme of
devolving responsibilities to the states, heritage workers must increase
co-operation with the states and begin using state registers.

World Heritage listing in Australia continues to grow, with the Blue
Mountains in NSW a current nomination. Australian geologists must play
their part in seeing geological heritage is fairly treated in current
and new World Heritage areas.

Pressing issues of practical management include:

• Consolidation of quarrying — many small pits are now commonly being
replaced by one or two large excavations which generally develop
rapidly, and are then reclaimed or filled in almost as rapidly. New
techniques of slope-battering and vegetation planting may limit
exposures even during operation, and related landforms such as volcanic
cones may be altered or completely destroyed.

• Mining and exploration activities — mines which do go ahead are often
larger-scale than in the past, and give rise to problems like those of
large-scale quarrying.

• Covering over of road cutting exposures and landform
features — new cuttings are now routinely being covered over and
planted with grass and bushes. However, given Australian weather conditions, this often does not work very well anyhow! Many
of our teaching and conference excursion stops are road
cuttings...where would we be without these exposures? Landform and
landscape views from established view-points are also lost by so-called
"revegetation" often without any historic evidence that vegetation is
being restored to an earlier state. Examples include the Organ Pipes
National Park near Melbourne, set up to display the well-developed
columnar jointing in a young lava flow, which is now largely hidden
behind rapidly-growing plantings of native vegetation.

Perhaps our next heritage problem is the greening of the Australian countryside!

The above may seem like a formidable list, but Australia’s strong record
of Earth heritage conservation activity will stand it in good stead to
meet the challenges ahead.

History of geological studies
Geological heritage studies in Australia go back over 30 years to the
first work by Geological Society of Australia (GSA) groups in Queensland
and South Australia. From the mid-1960s and into the 1970s, Society
Divisions (corresponding to states and territories) organised
sub-committees to begin pinpointing and promoting individual sites.
Correspondence and visits to the UK by Maud McBriar of South Australia
and other workers helped provide new ideas. In the mid-1970s, with the
aid of government grants, programs of identifying, documenting,
evaluating and recommending management of sites began across Australia.

The National Estate Grants Program, set up in 1973, and the Australian
Heritage Commission (AHC), founded in 1975, provided a long series of
government grants for studying features of Australia’s National Estate,
and nominating them to the newly established Register of the National
Estate. Grants totalling more than A$320,000 over the subsequent 25
years have resulted in more than 25 substantial volumes of
documentation.
A Standing Committee for Geological Heritage was established in the GSA
in 1974 to help improve the flow of ideas between the sub-committees. It
is also charged with liaison with Government and providing advice on
World Heritage matters. Its main objective is to promote understanding
and conservation of Australia’s geological heritage.

Techniques used in geological studies in Australia
Techniques developed by the UK’s Nature Conservancy Council were an
important influence on GSA work, although each GSA sub-committee
developed its own methods of determining the significance of sites. The
AHC built on some of this geological expertise to determine the
significance of sites at local, regional, national and international
levels for the Register of the National Estate.

A consolidated list of Australian sites of international and national
significance, drawn from sub-committee documentation, was published in
1986.

The GSA’s statement on policy in 1992 included the recommended use of
the term S i g n i f i c a n t G e o l o g i c a l Features, which are
defined as: "those features of special scientific or educational value
which form the essential basis of geological education, research and
reference. These features are considered by the geological community to
be worthy of protection and preservation."
This definition emphasises the two-fold use of features in education,
and for scientific research and as reference sites, for example type
localities and sections.

A recent grant from the AHC enabled the GSA’s Standing Committee members
and other interested heritage workers to meet at two workshops in
Canberra and prepare a two-volume methodology report which will assist
with future geological heritage work in Australia. The assessment volume
is available via the Web at www.gsa.org.au/heritage.htm.
The report includes a review of geological heritage methodologies used
in Australia and overseas, and a list of heritage publications by the
Society.
The result of the GSA’s work is that Australia has for years been
recognised internationally as a leader in geological conservation.
Work at state government level includes consultant projects such as
those of Rosengren in Victoria, including his recent study on the Late
Cainozoic basaltic eruption points of Victoria carried out with the
GSA’s Victorian sub-committee and the National Trust of Australia
(Victoria). A recent methodology to include geomorphological and soil
features has been developed in the Forestry and Parks and Wildlife
agencies of the Tasmanian government, and a major Victorian
government-sponsored study discussed the evaluation of caves and karst.

Parks and reserves
Parks in each state and in the territories provide valuable protection
and management for many geological heritage sites; often the initial
impetus for setting up such parks has been their geological features and
landscape values. National Park status is also used to provide
management of Australia’s numerous World Heritage areas, many of which
are of geological and landscape significance, for instance the
Riversleigh and Naracoorte fossil areas.

Other reserves which provide some protection for geological sites
include road reserves, water reserves, state flora and fauna reserves,
and in Victoria, for example, the small geological sites set up by the
state Land Conservation Council.

However, few parks services employ or work with geologists, and
management and interpretation are strongly biased towards biological and
ecological aspects.

Geological research including sampling is restricted in National Parks,
and new geological work by exploration or mining companies is usually
banned. There have been significant problems of management in World
Heritage areas such as the Willandra Lakes, and many National Parks are
poorly funded and interpreted.

Nevertheless, given the country’s awareness of the importance of Earth
heritage conservation, these are issues that will be taken on board and
dealt with.

THE gates holding back water from Menindee Lakes to South Australia
must be opened immediately, to prevent towns being flooded and water wasted, residents and station owners in outback New South Wales warn.

They fear so much water has been held back in the lakes storage, the
Menindee township will be flooded when floodwaters from Queensland reach
the region in about a month.

Already, about 20 billion litres of water a day from NSW floods are
rushing into Menindee Lakes which, at the weekend, reached the
640-billion-litre trigger point for the Murray-Darling Basin Commission
to take control of the water.

Water is now being let into Lake Cawndilla, which has a capacity for 557
billion litres, but no water is being let down the Darling River,
"pipeline" for water to SA.

Those warning of floods and that the Darling will break its banks and
water vital to replenishing SA's section of the River Murray will be
lost to bushland say the Darling system below Menindee Lakes can manage a
release of only 6 to 7 billion litres of water a day.

Obama's man in Australia visits Ballarat

HE'S been friends with US President Barack Obama for more than 20 years.
And, since September last year, he's been the the president's man in Australia.

So who better to ask about the possibility of a presidential visit to Ballarat than US Ambassador Jeffrey Bleich.

Mr Bleich made his first official visit to the city yesterday.

Accompanied by US Consul General to Melbourne Michael Thurston, the
ambassador met with Ballarat Mayor Judy Verlin and city council
representatives before touring Sovereign Hill and the University of
Ballarat.

But it appears Ballarat is not on the presidential radar.

President Obama had been due to visit Australia last month, but cancelled to sign off on his landmark healthcare bill.

The visit has been re-scheduled for June.
Mr Bleich said there were too many places he would like the president to see in Australia.

A new undersea mud volcano is erupting off Aceh following a massive
earthquake there earlier this month, a 15-member geological assessment
team sent to the province has confirmed.


Officials, however, were quick to add that the new volcano was unlikely
to pose a threat. “Based on our visual observations, the volcano is not
dangerous. But we are going to conduct an in-depth analysis this week of
the samples we collected, so we will have a definitive answer,” said
Ridwan Djamaluddin, director for mitigation and regional development at
the Agency for the Assessment and Application of Technology (BPPT).


Ridwan said the volcano, located near Banyak Island off the coast of
Singkil district, was currently 30 meters in diameter and eight meters
tall.

Local residents have claimed the seabed in the area has risen dramatically since the 7.2-magnitude earthquake on April 7


Before the quake, the waters around Gosong Turak reef
were 20 meters to 30 meters deep, but now were just five, said Mufliadi,
a Banyak Island resident


Villagers have reported seeing an undersea fissure spewing out mud and
rocks, and are worried an undersea volcano could be forming, he said.

Mufliadi said the phenomenon was first noted a week after the earthquake
by a fisherman who had been trawling for sea cucumbers in the waters
around Pailana Island, just off Banyak Island.

“He was shocked and came back to tell us what he had seen because that
site is a prime fishing spot for local fishermen,” but now there are no
fish there, Mufliadi said. The geologists, who traveled to the province
last week at the request of Aceh Governor Irwandi Yusuf, confirmed there
were no fish in the area.

“The fish around the area have gone and the water has become turbid,”
Ridwan said, adding that the water temperature had risen from 27 degrees
Celsius to 32 degrees.



To prevent worried residents from fleeing the area, Ridwan said the team
would work quickly to analyze the samples it had collected“We still
have to conduct an in-depth analysis of this,” he said, adding that if
the mud and rocks contained methane, it would be
dangerous.

A HUGE deep-sea canyon has been discovered off the Pilbara coast by a group of WA students on a field trip.

The canyon is near the Montebello Islands, the site of nuclear testing in the 1950s.

It is more than 1km deep and is the first one to be documented in the area.

The 14 biology students, some from the University of WA, were on a trip
from Hobart to Broome via Fremantle, collecting plankton and studying
the Leeuwin current.

The chief scientist on the trip, Anya Waite from UWA, said the students
were watching flying-fish and whales when some noticed odd-looking
contour lines on a bathymetric chart mapping the sea floor.

"Suddenly the contours on the map looked like someone had run a Texta over it,'' Prof Waite said.

"Their measurements suggested the canyon might be associated with
upwelling (an ocean phenomenon where cool water is driven up by wind,
taking nutrients with it to the surface) to the continental shelf, a
physical process known to make the surface ocean more productive with
plankton, the sea's main fish food."

Prof Waite said the find was "very cool" and described the canyon as looking like a ski-jump on the sea floor.

"There were some unusual currents there and we think the canyon has a role in funnelling the waters,'' Prof Waite said.

"There really haven't been any other canyons mapped in
that region. The oil companies have done some stuff, but everything
they do is completely confidential.

"We are up here discovering this stuff for Australians.''

The area is home to more than 150 species of coral, dugong, Indo-Pacific
reef fish,four species of turtles, 15 species of seabirds and 10
species of whales.

Undersea Volcano in Aceh Called Safe

An underwater volcano spewing mud off the Aceh coast poses no immediate
health or safety threats and has not lifted the seabed, government
officials said.

“We’ve conducted an in-depth analysis and there are no harmful gases
being emitted from the fissure nor a rise in the seabed,” Ridwan
Djamaluddin, director for mitigation and regional development at the
State Agency for the Assessment and Application of Technology (BPPT),
told the Jakarta Globe on Monday.

Local residents had reported the phenomenon shortly after a
7.2-magnitude earthquake struck the area on April 7. The BPPT sent a
15-member team to investigate two weeks later.

The volcano, near Banyak Island off the coast of Singkil district,
currently measures 30 meters in diameter and eight meters in height.

Residents claim the seabed in the area has risen dramatically since the quake.

Before the quake, the waters around the Gosong Turak reef were 20 to 30
meters deep, but now are just five meters, said Banyak Island resident
Mufliadi, adding that there were no more fish in the area, which was
previously a prime fishing spot.

The geologists, who traveled to the province at the request of Aceh Governor Irwandi Yusuf, confirmed the lack of fish.

“The fish have gone and the water has become turbid,” Ridwan said,

“We’ll send our team back to check pollution levels in the near future,”
he said. “We’re concerned the mud will spread and have a harmful effect
on marine life and on local people.”

Ridwan also said the Aceh provincial administration had sought funds from the BPPT to study the phenomenon.

CASHED-UP foreigners snapped up $14.9 billion
worth of houses and land in Australia last year, including $2.49 billion
worth of existing homes.


The Federal Government refused to release but they were in a Foreign
Investment Review Board (FIRB) report that was quietly posted online
last week.

It shows the Government issued 4827 real-estate approvals to foreign
investors last year for commercial and residential properties.

About half the approvals were for temporary residents wanting to buy a house as their principal residence.

A further 988 approvals were granted to investors to buy vacant land for
residential subdivision or to build a houses, according to figures
obtained by The Sunday Telegraph.

The report shows Victoria is the most sought-after state by foreign
investors wanting residential real estate, followed by Queensland and
NSW.
The FIRB granted 1562 approvals in Victoria, 1093 in Queensland and 956 in NSW.

But the figures are incomplete, because the Government changed the rules
in April last year so foreigners no longer had to notify the FIRB if
the property was to be their principal place of residence.

Under foreign investment laws, non-Australian residents can buy a dwelling for their principal place of residence.

The Government has been criticised for relaxing foreign investment laws, blamed for driving up house prices.

Although the Government announced last month that it would adopt a more
stringent approval process, experts claim the latest changes will have
little effect on the market.

Opposition finance spokesman Joe Hockey said it was clear that foreign investment was having an upward impact on housing prices.

"The Government has been all over the shop on foreign-investment rules
in the past 12 months," he said. "What is clear is that their rules
making it easier for foreigners to buy real estate have put upward
pressure on housing prices."

Immigration-law specialist David Stratton said the new amendments focused on penalties for non-compliance.

"In one sense, little has changed: foreign residents can still purchase
Australian properties and, in particular, people in Australia on
temporary residence visas can still purchase existing dwellings," Mr
Stratton said.
Foreign-owned companies are allowed to buy second-hand dwellings to house their Australian-based staff.

A developer can sell an unlimited number of dwellings, either off the
plan or newly constructed, to foreigners, provided the properties are
advertised locally.

In 2007-08, the biggest foreign investment in both residential and
commercial real estate in Australia was made by buyers from the US,
Britain and the United Arab Emirates.

The following year, Singapore investors topped the list, followed by the US and Britain.

The Opposition has called for a comprehensive study of foreign real-estate investment.
